On the question of if you can be married, YES. But that is not an assurance that he can petition you. For one, (I am no legal expert) but what I know about same sex marriage is that the country where you reside has to acknowledge it too. He can get you as common law probably?
If they get legally married in Canada or another country outside Philippines, then they can definitely apply under married spouse class for PR sponsorship. CIC doesn't care what Philippines thinks about the marriage.

Don't give me virtual attitude

This information is valuable. It might help with proving the legitimacy of the relationship because lot of straight OR gay partners who have a big age difference have limited intimate encounters during their relationship - or so says the stereotype

If you've never met in person, it doesn't matter about the age difference. You have a very bad chance of getting into Canada. You need to spend time together in person before you apply for your PR visa. Forget the age difference. Never meeting in person is a huge red flag.

I know that you are in love and in a genuine relationship, but you have to take a step back from your emotional feelings for just a sec and look at it from a CIC' Visa Officers eyes, would you as an officer feel your relationship was genuine. I am married to my husband and we met over the internet and he is still in Canada and even though I know our relationship is genuine my application was based on proving this to a stranger who might not think so. This is quite a large age gap and it can make CIC question some areas of your relationship, also you have never met in person which is also an issue for them. My suggestion would be that you apply for a tourist visa again with all the correct documents and fees and IF they do grant you a visa then you can further explore the possibility of being in Canada together. The best solution would be that your BF travel to you a few times so that you have proof of relationship such as photographs and that he has met your family etc. Although I understand he has a medical condition, however does this really prevent him from travelling?

You should also try and meet your partner in person for you and not immigration. Beeing in a online relationship and being in a relationship in person are really different experiences and making sure he is the right person for you. Immigrating to a different country to live with someone you have never met in person will be extremely difficult especially emotionally.

I hope you are successfull in whatever route you decide to take

x

It may help, but if you've already told them you plan to go marry your boyfriend, I don't see them changing their minds.

Also, getting married on the first visit is a red flag too.

Have you looked at other options to come to Canada so you and your boyfriend can live together for a while? That way you will have cohabitation as proof for your application. Living together unmarried is legal in Canada, so there's no issue with that part. Plus it will give you time to test the relationship and make sure it's right for you. (Just a personal tip - I met both of my husbands online. Online relationships are a lot easier than in person. In person you actually have to deal with the little things your husband does that annoy you... like leave empty coffee cups all over the house. :p It's good to be together IRL for a little while to make sure the relationship is right for you.)

Yeah he cannot leave his country he go every week end in the hospital and have his blood test, his condition is quite serious and need monitoring with his blood. We are in the same condition, we take the same meds. That we understand each other. I know how hard it is im just after the time that we will able to soend together.

I did not told them that im going to get married in canada just for vacation only. I did look another option this is the easy way, the TRV its ok for me to wait but im scared about the time, i mean his condition. Should it work if i present a papers stating that i am enrolled in a review for my upcoming board exam this dec. and the review will start on july, i wil apply a 3~week vacation only this may?

I'm sorry but I think this would also be a red flag if you have to do a medical. You night be able to pass a Spousal Class IME but I have a feeling that you might fail the Excessive Demand test in any other class. I am not asking what the medical condition is, and I don't want to know. CIC however, will...

i have been thinking about your case and I have discussed it with some lawyer friends of mine (not Immigration lawyers)

Although I dont recommend 'conjugal' class,it could work in your case. You say your partner cant travel due to medical. If he can get a letter from his Doctor, then you might have a chance.

Once again, your partner needs to speak to Immigration lawyer/consultant that deals with same sex Immigration

Where abouts in Canada is your partner. ? I ask this because this is important if you are denied. Appeal waiting times are about 2 years in Toronto.

Im afraid you are in for a bumpy ride !
