How to obtain PR for wife after I Land

Hi All,

I have recently got passport request and am planning to land in April 2016. My wife is currently in US pursuing her research. When I applied in Express Entry, I mentioned that my wife would not be accompanying.

I want to apply for PR for my wife once I settle down there.
1. Could anyone please suggest how should I proceed?
2. Will her PR procedure be same as I followed or she can be brought on Dependent status also? If on dependent status, would she be able to work in Canada?

Kindly suggest.

To be clear, is/was your wife "declared" on YOUR application, i.e. medicals completed and submitted?

Hi Truesmile. Thanks for your response. Yes, my wife was declared in the application. Medical is done for her. In the application, there was one section why your spouse would not be accompanying. There i mentioned that i want to first settle down and then want my spouse to come over.

After you land as PR you will need to sponsor your wife using a family class application.

If she can get a TRV to enter Canada and you apply as inland, she will get an open work permit after 4-5 months but the whole process will take 2+ years before she gets PR, during which time she is not supposed to leave Canada.

If you apply outland she can stay in Canada only if she can get valid status (as visitor, student or worker) separate from the PR app. There is no work permit with an outland app, but processing time is much quicker. An app processed in New Delhi visa office would take approx 1 year.

3. She is currently in US but holds and Indian Passport. I am not sure what her visa office would be in this case.

I'm not sure on this better to ask in the visitors section of forum.

If she has a green card in USA I don't think she even needs a TRV.

As long as the passport is valid. If OWP expires and PR is still processing, I think you can extend it (though not completely sure).

The choice of visa office is up to CIC, not you or your wife. CIC can choose to use visa office based on her citizenship (New Delhi) or current residency in USA if she has valid status there for at least 1 year (CPC-Ottawa would process). Either way though, you can expect around 1 year for processing. Only difference is if they want an interview it would be in ND or USA depending on how CIC decided to process it.

It would be far easier to simply change your wife to accompanying. She can land with you to become a PR and return to the US to finish her job or school while you get settled in.

Agreed. She can do a short landing and then she can leave and continue her studies after that. As a PR, she may be outside Canada for up to 3 years before losing her PR.

She just has to land at some point after you land and before her PR visa expires.

I have submitted my passport. Can I now change the status to accompanying?

Yes. You can change her to accompanying at any point before you actually land as a PR.

Let the visa office know that you want to change her from non-accompanying to accompanying and send her passport in too.

Considering she is in US now since 3 months, would they ask for FBI clearence? Moreover IELTS, ECA would be needed or not? Can this process of including her now jeopardize my PR as well?

No, you are not required to submit any other documents for her. The requirements for the app are the exact same regardless of whether she is accompanying or not.

Ugandan wife. family on Canadian passports. Father passed away. Moving back home

Hi are you able to assist me. I live in Qatar, graduated U of A. Teaching at Qatar Foundation. Father passed away. Moving my family back to Kamloops and our boys ae on Canadian passport born here in Qatar but my wife is still on her Ugandan passport. natural mother of our children. my only wife ever. need to get home. Legally married have all documents, pictures,etc. buT i want to know if its better to apply for her PR now OUT OF CANADA or wait till we get to Canada.
