Explorer101,

One of my friend has obtained canadian citizenship, living and working in UAE with his family. Even his son was born in UAE, he just went Canada, got the necessary documentation done for his son and came back to UAE. I am not aware if the same rules apply to the citizens or not, but sounds somewhat unusual to me that you lay a rule, one complies and yet PR is denied :( Can't it be challenged in any court of justice !

probably that has happened a few years ago...i believe things have changed now with many people recently getting RQ when applying for citizenship, i also heard of many people who got citizenship (before 2010) while they stayed only a few months in canada....those guys abused the system, and thats why the newer immigrants suffer.

I find it hard to understand that how come the immigration officer refused to handover the PR card, even after fulfilment of 2 years of residency. How can anyone judge my intentions and how can immigration officer make a decision over something which s/he is not aware of. I might be planning to stay permanently after i get my PR card, how come immigration officer make a decision based on imagination ?.

While I have not personally researched thoroughly about the foregoing, I want to believe that Explorer's account might be accurate. This is due to my understanding that Immigration officers have a right to decisions based on discretion on any case they are processing. And this decision is usually reached based on "careful consideration" of circumstances surrounding ur application. Therefore, in spite of satisfying minimum requirements, an immigration officer might proceed to refuse an application if not satisfied based on other considerations.

Just like clearance officers at the airport have similar authority. This allows them to refuse entry clearance to an already landed immigrant. So one has to be careful about dealing with immigration issues... They use the laws but they also use discretion. U can only overturn a decision made based on discretion through a fierce legal means.

This is indeed news for me. My mind is actually racing to figure out - What would convince IO, if one is genuinely interested to live in Canada permanently?

Maybe the following:

1. Selling of property in home country.
2. Efforts to find jobs before entry. Show interview letters to IO (?)
3. Taking admissions in Universities (Paperwork to prove).
4. Transfer of money to Canadian Bank.

This is ridiculous....but true! I cant think of any more ideas .....:(

I would urge my friends to spread this word amongst their friends so that people are aware.

I was also under the assumption that 2/5 years stay is the only requirement for maintaining PR status before I came to know about the shocking deportation orders about 2 years back.
I would say job, business, studies in Canada will show ties in Canada. The stay in Canada should be continuous and travel outside should be of limited period and not vice versa is also a way to show ties in Canada.

Meaning it all depends on the immigration officer to determine if you have enough social ties in Canada even if you satisfy the 2/5 year rule. Folks I think we need to educate our friends on this.

On the other hand, I guess my idea of staying away for a year in a row won't pose any problems when I finally decide to go settle fully sometime next year.

I guess the case explorer is referring to can be one in thousands and it has been seen that such discretionary powers given to the officials are also not exercised so frequently (this is the first case of its nature that i have heard so far)I fear there might have been some observations of severe nature about this couple which led IO to go to that extent. Could be spreading some objectionable provocative stuff on internet against the govt, immigration process, religion,etc

Reading the posts here has started worrying me....

I landed last year returned back to home country and later came back to Canada in Oct'12..Got a good Job and since then have been working for almost 4 months now but my family is still in India and they plan to join me in Jan'14, for them it will be a full 18months after completing landing although My wife came to Canada once and stayed here for a month but now I'm starting to worry after reading these posts here...On the other hand since I have been working full time here I don't see that there should be any issues?

Any thoughts guys about my case? Just curious hear something good or bad!!!

I dont think that you will have any problem as long as your wife can give some reason to VO; if he asks that question. Otherwise there wont be any issue as you are staying here.

I think your family will be fine cos you being the primary applicant is well settled. And I will suggest wife should visit once in a while.
