Yes - this can impact your application. You need to send an amended form to your visa office.

Did you check YES or NO in the column where the question was asked? If you checked NO that might amount to misrepresentation...but checking YES and not specify might not be viewed as misrepresentation.

We didn't tick also in Yes, because it was tricky question, we ticked in No, but in the form and explanation letter we explained that I was refused TRV visa when and why.
Di you think it might be also seen as misrepresentation???

Yes, because the answer is not the true and correct answer, even though the explanation is provided.

Once your application is sent to the visa office that will process it, and you have a file number, send a new form with the correct answer 'yes'. You have already explained the refusal, so that should be fine. You should attach a short explanation to the new form stating that you made a mistake, and give a short recap of the explanation of the denial.
It is misrepresentation, and the PR visa could well be denied because of this, so send in an amended form.

Our file is already 7 month in Warsaw, and just now we noticed it, but my husband wants to go to a layer in Quebec and find out, because as I read in CIC , Misrepresentation is when person is hiding information and they find the truth or if I said I am not married but in fact I am merried.
Really confused (((

Definitely send in a new form with the correct information and an explanation. I would send it by courier to the Ghana office, and also send a copy by email.

People have been refused for answering this very question incorrectly.

If the application is rejected because of this, you would probably win on appeal, because you did include the details in your application. The judge might then find that your intent was not to deceive. However, you do not want to go to appeal - it takes a lot of time, and you should really have a lawyer for it, so it will be expensive.

The best course of action is to just submit a new version of the form, with the correct answer and an explanation of the circumstances of the refusal, and an explanation of why you answered differently before.

Thanks for a reply
But my worries are, would it not postpone our process and won't it give them a chance to look at our application more closely as they may think I have some more mistakes.
And I found I have them, I have some mismatching date with my TRV visa that i applied before and get refused and in the forms for my sponsorship. So, mismatching information can be considered as lie also?
P.S. where I can look at these cases, where People were refused for answering incorrectly in the form but not with the bad intent?
Merci :-*

How is this a `tricky' question?

You decided to explain the situation, but...why didn't you also change the answer to YES?

The visa officer is already going to have questions, because you answered 'no', but then explained that you had been refused a visa. Sending in a corrected form might postpone the process a bit. Not correcting this might postpone the process more. It is possible that the visa officer will not notice, but I would not count on that.
