Help - how does being denied entry affect our situation

Hello All,

I was just about to go up and visit my boyfriend for just over a month, and was denied entry as I don't have a job and couldn't prove ties to the US.

My concern is that now my passport is "flagged" and I have to provide documentation each time I attempt to go visit of my ties to the US (which will be much easier once I have a job.) Will this affect my ability to do an inbound family class sponsorship? Will it have any affect at all?

I am also looking for LMO temp jobs up there right now...as that is what was suggested by the border patrol agent denying me.

Does anyone have any advice for how this should work? We have talked about marriage...but are waiting for my divorce to be finalized also.

What a mess.... :(

Any help would be appreciated.

The next time you try to cross for a visit you have to show that your circumstances are no longer the same as they were the last time you tried to enter. As you said, you do this by showing a job, apartment lease, and other ties that will bring you back to the US after your visit. That should work. And why are you thinking of an In Canada Class spousal sponsorship? Unless you are IN Canada, this cannot be done. You would have to do the Overseas processing.

Try a shorter visiting time.

Unless you have skill in a trade or a degree in an in-demand profession, don't get hung up on finding a job with a LMO. Canada actually decreased the number of TFWs from 2011 to 2012. You can still try to find a job, just don't make that your ultimate goal. Not trying to be negative... I've been looking for 18 months for a job. Jobs I'm qualified for won't get a LMO.

No, it won't hurt your spouse sponsorship. It will make it harder to enter Canada though.

It would really help if you get a job. Without a job, it might look like you're planning to go to work in Canada. I wouldn't mention that you're looking for a LMO job either. It was a nice suggestion by the IO, but in reality, you're admitting you want a job in Canada.

Ok so let's say that I get a job here in the states, and two months from now we decide to get married.

How do I get across the border to live with him up there and do an inland application with my passport flagged like this. Just because we are married doesn't mean that they won't hassle me going across the border married or not.

We have heard that with my divorce ppwk it can complicate things in Canada as well- his sister is getting married to a divorced American and the Canadian side is giving them hassle about proving the reasons for divorce were legit.

So if we were to get married in America - how do I get to go home with him?

My husband and I are both divorced and we've had no issues with our application. We made sure to include copies of our divorce papers. :eek:

Is there a reason you don't want to do an Outland application?

If he's with you and asks the IO to take you with him, there's a much better chance you'll get across. Flagged doesn't mean banned. If you pay the fees for PR ahead of time and take the receipt, that will help the IO see you're serious about getting PR.

They were having trouble with getting their marriage license - not trouble with sponsorship.

I would prefer not to do an outland application just because it is so hard to not be together. He has a job that limits how often he can visit me in the states, and I don't have a job yet- meaning they won't let me cross to see him with my passport flagged. So it is miserable having this border between us when all we really want is to be together.

So ideally what we should do is get married, submit the sponsorship ppwk and then have him come pick me up and bring me to canada?

We only live about an hour and a half from each other...and I just moved here to be closer to him...which has made it even more frustrating that they won't let me cross - because I am so close I can practically throw a stone at his house.... GRRR

Different day, different IO and you'll get across just fine. Like I said, you are not banned from crossing.

The application for Inland/Outland is almost the exact same. (I actually think the Inland forms are more silly and take longer but just opinion there.) You can be inside Canada and file for Outland PR. That way, if you need to travel back to the US for any reason, you can. Inland travel isn't recommended.

Once you get the PR application in process, the IOs are usually much more helpful towards Americans.

We also had no trouble getting the marriage license. We read the website ahead of time and I called to clarify any questions I had. We brought extra forms of ID (I literally had 12) and the originals for each of our divorces. Registry took a copy of mine (as in she made it herself) and nothing for my husband because he was divorced in province. It took about ten minutes and we had everything we needed to get married.

So even though I wouldn't have a job, as long as we have submitted some sort of form re:sponsorship they would be less likely to give us hassle?

And I can still live in Canada with an outland application? His biggest concern is that he wants me there with him...he doesn't care how it happens...but just being able to be there with him is his concern.

I am just so nervous to attempt crossing again...they make you feel like such crap.

Yes, but it needs to be an honest intent. I would suggest shortening the length of your visit. If you say 1 week and enter Canada, then decide to stay, you can deal with it. (No date on the stamp is six months even if you only asked for 1 week.) It will help considerably if your boyfriend/husband can cross with you.

You can apply In or Out. You'll just need to decide what's right for you. Reading Leon's thread pinned to the top will help give you some ideas about each.
