Honestly, it's so difficult to say. The fact that the onus is on the applicant to provide the evidence can always be countered by the government. Remember, I am not a lawyer or member of the government making these decisions, but playing devils advocate, you claims on the war could be countered with the improving conditions due to the down fall of ISIS, iraqs increased oil production (economic improvement), etc. I still think the effect on your children (one daughter has been in Canada more than half her life) and their integration into Canadian society would be the strongest compelling factors. Not that they won't consider other things, but effect on children seems to be a significant consideration both with IRB and the courts. For research sake, check some of the court results in CanLi.

No one on here can say if your H&C grounds are sufficient or if the app will be approved or not. H&C is very much a case-by-case process. People claiming the same hardships can have completely opposite results, depending on the other circumstances of their lives.

If your daughter was fighting cancer now and needed treatment, that would definitely be a strong factor. However, she is currently healthy and only in need of more frequent check-ups, so medical treatment grounds don't really apply to your situation.
 
We are just trying to provide feedback on this forum. Given that your child is already in remission it would be difficult to prove she needs to be in Canada for medical treatment. Unfortunately your case has been denied a few times already so it will be an uphill battle. I would think that you need a good lawyer to advise you what would be your strongest argument. Unfortunately there are many places in the world that are far from ideal to live in. There are also millions of Kurds still in Iraq. You will have to give examples of why your family's life is in danger versus others who are living in the same region.
 
I suggest you get your daugther specialist plus her pedertirican to write a letter to Irb to say listen if they cannot go back to Iraq there is no proper medical care and if God forbid her cancer come back there is no proper medical treatment or have medical professional to back your case
good idea. u have to get written reports from your daughter pediatrician and oncology doctor to explain the reason why her condition cant b followed up in iraqi.

I applied on last April, and the website shows Received my application May 12th. but I updated them with more evidence couple of times. I have Family, with 2 young kids. and working since February, paying taxes, what are the expectations?

We received your application for permanent residence on May 12, 2017.
so its not 2016 I meant last May, in 2017. I still waiting, no updates, how about you, do you have any case applied to CIC. can you share yours as well?

My application was received in April, same as you, I submitted my application in March instead. There is no update to my application too.

I have a question. She is not going to school right now and I am not able to work right now as we just applied. How long did it take to get your open work permit? My daughter is not able to go to school until we get it?

You will qualify to apply for a work permit once a positive stage 1 assessment has been made.

I think it might be 6-8 months but I'm not certain. I'm sure others will comment.
