So yes you shoud choose refugee claimant. Then they will ask if you got approved to apply PR inland as ( they will name few programs where you will see H&C) put yes and continue the questionnaire .

Don’t believe there is an actual requirement to stay in Canada. It should be processed whether you are here or not.
 
Hi everyone Can anyone give an advice, i did apply for H & C in 2018 through a lawyer, and their is need for me to update my application by submitting some document to immigration, but the lawyer is not available. Is it possible to send the update to immigration personally and how do i go about it. Advice will be greatly appreciated. Thank you.

Folks, anybody here waiting for PRRA and HC at the same time? My cousin waiting for both at the same time - we are praying to get AIP before negative PRRA, but, oh well, all in God’s hands.

Thanks for your reply! He applied HC in April 2019 and will file in August PRRA. CBSA said PRRA takes 6-12 months, so there is a small chance HC will be decided by then. But if not, cousin will have to leave and wait HC decision outside Canada. Because HC in process does not defer removal order.

Do you have any plans during this wait, like going to MP etc.? And how long your PRRA has been in process, if you don’t mind sharing?

Since H&C and PRRA are both handled by Humanitarian Migration Branch, they are almost usually processed concurrently despite not always decided at the same time. If your cousin gets an AIP before the result of PRRA comes out he'd get a stay of removal that suspends removal order.

Yes I know. But the problem is that HC takes over a year for Stage 1. While PrRA likely less than a year...:-( so we are mentally prepared for the worst case scenario...
 
One information for you is that CIC never take "It is not my fault" as an valid excuse for any misrepresentation. You are the applicant and you have the full responsibility for anything you put on your claim and applications, not your lawyer, not your friends and not anyone else, but you. Since you have been found misrepresentation, you are effectively banned for 5 years from Canada, so I don't think you are qualified for PRRA.

Just to note for the benefit of people in the same situation, Mis representation does not in itself disqualify from PRRA. My cousin’s PR was lost because of mis representation and he became inadmissible for 5 years, but he was still offered PRRA application before removal. Even our lawyer was not sure whether he was qualified, but - surprise, surprise - CBSA agent handed PRRA forms without giving us hard time.
 
They have received my H&C application on June 24, 2019. How long does it take for receive a confirmation letter that my application is complete and it is ready for processing for stage 1. My understanding is they first scan your application and if anything missing and not complete, they send it back or they let you know what they are missing, etc.

Multiple months. Usually a year or more to hear if your are approved for AIP. If you are applying for a parent or grandparent there is a specific program called PGP. Parents and grandparents do get refused for H&C and then they have difficulty ever visiting Canada again.
