H&C Humanitarian Ground with/or Without Failed refugee claim

Yes this is my first H&C application for my parents.
Factors :-
1. They are aged and have no siblings/parents back home, all immediate relatives are in Canada, United States and Scotland.
2. Their elder son (my brother) is a patient of Schizophrenia and is dependent on his father for which got a recommendation letter from his doctor in a Civic Hospital. (My brother is a Canadian Permanent Resident)
3. My father is a social worker and always contribute more than 1000 Volunteer hours every year in Canada for different organizations.
4. My father is on Work Permit and contributing to Canadian Economy.
5. Some other factors like investment in Canada so far and proposed investment plan.

Thanks for sharing. I also have HC for my parents. BIOC is main factor, establishment in Canada, no relatives back home (no parents, siblings, children or grandchildren). Also adverse country conditions. 1st HC was refused. We are waiting for second. Theyve been on super visa for 10 years, we didnt make it to PGP. Now if they leave chances of coming back is very small cause they have no ties back home. Plus they have HC refusal so most likely they’ll never be able to come back as visitors if they leave. PGP is not available and govt does not promise us anything even after 10 years so only option left is HC to be reunited with family.

Hi all. I just called IRCC. She told me we can’t see if there is any officer assigned to your file but when I called them last time he said someone is assigned. Also should I send a new webform if I found better job with better salary?

Hello,

The first step for any H&C refusal is to write a simple e-mail to them asking for the "reasons." I don't know the email address.

The reasons have to be read for any second step to be considered, but if it's reconsideration then you have to identify where the officer got it wrong. Simply asking them to turn "no" into "yes" won't do. You are trying to convince them to correct themselves, so I'd say if the officer misquoted something, or made some mistake that if seen properly would cause the decision-maker to alter the decision - that's what will be effective.

Any decision by any Federal entity can have that decision appealed before the Federal Court of Canada if the court will grant leave to hear the appeal.

So, somehow someone has to pick the decision apart to see what is unreasonable about it as that's the threshold for decision-making on H&C applications - reasonableness.

And you can't determine that without the written reasons.

Could you tell me when did he apply/the application age?after how many months since submission they have refused the application?

I submitted my application in October 2023 but haven’t received any response yet. I also haven’t submitted any additional documents since then. Do I need to submit anything further? Just to clarify, I have three kids, one of whom is Canadian-born.

Hi my friend...I didn't wait for the medical forms...I did the exames without them...only using the AIP letter and my passaporte...My lawyer recommended me to do it to save time, you can call the clinic to check it out.
I only received the medical letter 3 weeks after my AIP....I think it was worth for me.

In case you or someone else lives in Toronto area....that's the clinic address you can do your exames with just with your AIP letter.

If they need medical they will send u separate email so don’t worry about that, they send me medicals after almost 8 weeks after AIP and they send it only for my wife

I have question regarding H&C, my brother just turned 20 , has been living in India with my father (our mom passed away in 2014), sept 2024 my father passed away leaving us with absolutely no extended family.
My brother has multiple entry Visa to Canada which is valid for another 8 yrs. So I called him to come stay with me. (me and sister are Canadian citizens).
I want to go through H & C way and apply for his pr , so he can live in Canada as we are his only blood family now.
Does anyone has any pointers I should consider, he is not capable to live all alone back home as he feels lonely and depressed.

Hi, please i need clarification on my H&C application on the best interest of a child who has some medical condition that can be treated in Canada. I applied through a lawyer.
Application submission was 21st June 2024
Biometric was done July 18, 2024
I have not gotten AOR.
Please house how can I know if they had actually started processing the application because the information I have is that the H&C can be processed faster because a child's health is involved.
