A spousal sponsorship and H&C are two different things. You must have an inadmissibility such as a criminal conviction, or a medical condition.
A spousal sponsorship is a completely different immigration stream. Perhaps you're commenting here but should be in the Family Class section?

The short answer is no. The application is a spousal sponsorship application. It will be refused if your partner withdraws sponsorship.
