how long it will take to process my second h&C application? is it true my second h&c application will be on hold because of judicial review ?
My application got refused after years in process, it was in Niagara office but I got refusal from vancouver.
i am confused, what are you thinking? why would you go to court when you can apply for 2nd file directly. who is gonna defend you in court? legal aid office?
which one is easier? filing a HC or defending you in court? if your lawyer cannot even do the easy one right, why you trust he/she on the challenging one???
Even i knew when i prepared my file, the pandemic is not a reason to stay in Canada for humanitarian purposes. if the ircc was gonna issue PR to people who were stuck here because of the pandemic, there would be millions of them.
i know but what can i do? , if i don't file a judical review CBSA will be after me. my case was strong everything perfect but because of pandemic they refused it.
by the way, if you dont know what the judges would do, they dont review on your file if you can get a PR, when you take the case to court. You or your lawyer must point out the errors the agent has made in the decision-making process. Its you against the agent, not to evaluate the case itself.
why dont you try PRRA? have you talked to the lawyer or have you done the research before making choices?
first of all, trust your ability in doing things
second of all, pay a little fee to consult with a real lawyer if necessary
third of all, break up with your current lawyer, he or she is an amateur
You're right i need to strat doing it by myself , if i know how to write good in english i will never consult a lawyer and that time when i was in canada i didn't know nothing , just because of little mistake in my application cost me everything , and decistion make took this mistake against me. i'm pretty sure my second application will be strong because i know what to do now.

Again, let me do the math. Opening a file in court usually costs 120 dollars, with very few chances to win. But waste you a couple more months. Plus the time you will be waiting again on 2nd HC. Without a work permit, how long your finance will last?
Or talking to a new lawyer, it will be another one or two weeks. He or she will give you a better suggestion for stopping deportation. Or, once your 2nd file is received by IRCC, and they give you AOR. You will be safe till the result whether is positive or negative.
Prra is also on the table.
If i were you, i would start to search online for a list of lawyer, and call a lawyer asking for an appointment ASAP. Before doing that, zero thought on judicial review. Because it will consume too much time. Plus you have children to raise.
Make plan A B C D, and prioritize them from the best move to the least best move.
