I am her only surviving child. My only sibling died 20 years ago. She is in Canada now. Her brother, who is a Canadian citizen, invited her for a visitor visa before our PR approval. So, she came with us when we first immigrated to Canada in 2024; she just went to the USA once for 5 days with my husband, as there is the 6-month limit on a single stay. She came back again to Canada and continues living with us. But considering the old age and the harsh weather, it is too difficult for her to take this journey. About H&C, how to increase the chance of the approval? If you have any ideas, please suggest them to me. I would be grateful to you.

I would avoid having her leave Canada since there is never a guarantee she will be allowed back into Canada. She should apply for extensions from within Canada instead. It's quite possible IRCC may refuse to extend her status at some point once she has filed the H&C application. If that happens, she should remain in Canada without status until there is a decision in her application.

Just to add, in Quebec the processing time is 48 months.

Yes, we are in Quebec as we got PR through provincial nominations. If I apply for my mother on H&C ground, do I have to apply for her visitor visa extension too? Also as the processing time is long in Quebec, can she stay the full time with us?

The H&C application does not give her implied status. Yes, she should apply to extend her status from within Canada. Yes, she can remain with you.

She should not leave Canada while the application is being processed. She really needs to remain in Canada.

Leaving Canada will weaken her H&C application. She may also have issues returning to Canada and end up stuck outside of Canada.

Consult with a good H and C lawyer,tell her to do some volunteering activities(if possible),add support letters with your application from her brother and relatives,mention all the hardships she will face in her home country,remember if you decide to hire a H and C lawyer,it will cost you around 10k,so be prepared to spend this amount of money,good luck

Hi everyone, I have an urgent question and I'm freaking out right now .
I was suppose to go to my monthly CBSA check in today and some how It totally slipped out of my brain . And I just realized it an night that I was suppose to go there . Is this a big issue ? Can I go there tomorrow now ? Will I be trouble ? I have been going there since 2 years now !

You should call CBSA right away and let them know whole scenario before CBSA takes any action against you
not expert in this matter may other members can help you in this regard
