Is is possible to claim H&C under best interest of child even the child is outside Canada?
Or must do only:
Hardship and establishment, because my child he still in my country.

if you asked member we said no
But if You asked a lawyer she/he would say yes because they want your money

That won't make sense. If the child isn't living in Canada, then there's no hardship or establishment argument.

U can claim hardship if the child is out of Canada.if u have kids out of Canada who depends on you for food,school fee,medical bills or basic necessities for life and if u are send back home you won't he able to have money to provude them all thise stuffs,thats hardship

"A decision on a humanitarian and compassionate (H&C) application must include an assessment of the best interests of any child directly affected by the decision. “Any child directly affected” in this context means a Canadian or foreign-born child (and could include children outside Canada)."

No one can anticipate every circumstance where the welfare of children is concerned, however.., it's a steep hill to climb. Regarding an earlier comment by another about the relative greed of lawyers, they're paid to connect these dots as best they can so that they align with Canadian H&C policies. It often takes a mind free of emotion to detail how the circumstances of a family conform with policy.

Just saying that life would be better in Canada rather than somewhere else.., that doesn't cut it.
