Hi guys, I have applied for refugee in 2018, and in 2021 I got a negative decision, so I appealed and I got another negative decision a week ago. I have 2 boys who are both over 18. My file is weak due to my first lawyer ruining it (turns out he was a consultant not a lawyer) and I don't know what to do now. we have strong grounds to apply for H&C (own a house, never took benefits, work, members of church) but we are scared of removal orders if we have to wait for the 12-month bar to be over. any help would be greatly appreciated... thank you all!

Sorry about your situation. Sadly your kids are over 18 so you have to wait for the 12 month window unless you have any serious medical condition. Nonetheless, you can apply for JR if you haven’t done that but if you have, then wait for the outcome while you pray and hope for the best.

The issue with CBSA is either here nor there. They may not contact you until everything is sorted out. Most importantly is for your work permit to be active until you can apply for H&C because it’s key and very important to show prove of work and other documents relating to your stability in Canada. At this point, I won’t advise you to put your eggs in one basket since your kids are adults. Let them explore other avenue too.

Above all, keep calm and pray in whichever way you believe and this too shall pass. I wish you the very best.

Hi everyone, can someone help me with the following question: what "exemption" are we asking IRCC to approve? My dad is not inadmissible so I am not asking for that. In this case, is my dad asking for exemption of family reunion or economic class criteria?

If you are not seeking exemption from inadmissibility, you will have to explain why you are not applying under a more "normal" stream like family sponsorship or economic class. So it would be seeking "exemption" from his inability to qualify under those streams. Because HC is the route of last resort.

When did she come to Canada??? Did she complete her school?? Is she still sick? Is it a sickness that can be treated in her home country or not? Is she still in status? We need answers to these questions to give proper advice here. Nonetheless, she may apply for H&C but…..you have to also remember that lawyers just want their money and to make as much as they can from those of us that are really helpless.

My sincere advise for such person after the answers to the questions raised would have been to sort a marriage of convenience with a PR holder or Canadian citizen. There are lots of gurus here that will or may have better advice but the person in question will have to answer the questions especially the part of her sickness and the availability of treatment in her home country.
