Hello everyone
I have a question about my mother who is currently on super visa and staying here in canada with me if I apply her immigration within canada on h and c grounds what are the chances of approval ?
Her age is 57 years and she is by herself in India (widow)as she has two sons and we both are in canada.

H&C apps for parents generally only stand a chance if the parent is quite elderly and in need of care. Your mother is still of working age, not even close to being elderly, so there is very little chance of success.

You will need to try to sponsor her through the PGP lottery.

What is the upper limit of elderly? Like if parents are above 70 years and requires real care. Can their canadian children apply for their PR on hnc grounds??

Others can comment there is I believe no hard rule but of course the older someone gets the harder it gets to justify that an individual will not become a drain on Canadas social care and health facilities regardless of their sponsors financial status .

So from an ongoing care and financial viewpoint if nothing else the case would need to be convincing let alone any H&C reasons which will still be very difficult to show, if it were not then there would be no need for a parent stream , albeit a lottery, as everyone would try the H&C route which in itself might take some time to even process..

Which is why for many people just the super visa route works for them, overall a less complicated a process

H&C is a last resort option with a high rate of refusal, even in these cases. It takes years to process, during which time your parent has no access to health coverage or any form of assistance from the Canadian government. You would have to pay all of their medical expenses. Know that H&C is not a workaround for medically inadmissible people.

You should be focusing your time on qualifying as a sponsor and applying for a spot in the lottery.
