Dear Members

I am from Bangladesh and I got the Canada PR visa last month and planning to land end of july this year. But last afternoon I received the USA DV lottery 2011 1st letter. Now I am little bit confused regarding this issue.

Members pls give me some suggestion.

1. What should I do?
2. Can I maintain Canada and USA PR simultaneously?
3. Any other option/opinion?

Once you are canadian citizen you can go to USA any way so why loose candian PR and go for USA..

Depends upon your priorities. If I would have been in your shoes then I would have opted for Canada PR strictly as once you become Canadian Citizen then by just minimal paper work you can travel and work in US as well. Rest its your call.

Follow these rules and you'll never lose your status as a permanent resident of the United States.

Once you receive a green card, there are only two conditions required to keep it for life. First, you must not become removable or inadmissible. The most common way of doing this is to be convicted of a serious crime.

The second requirement is that you not abandon the United States as your permanent residence. Residence, for immigration purposes, is a question of your intent when you depart the country. As long as you are not planning to make your home somewhere else, then legally you are still a resident of the United States. Problems arise, however, because the U.S. Citizenship & Immigration Services (USCIS) will try to judge your intention by the way you act.

As a general rule, if you have a green card and leave the United States for more than one year, you may have a difficult time reentering the country. That is because the USCIS feels an absence of longer than one year indicates a possible abandonment of U.S. residence. Even if you do return before one year is up, you may run into trouble. To avoid a full-scale inspection, you should return within six months.

It is a common misconception that to keep your green card all you need to do is enter the United States at least once a year. The fact is that if you ever leave with the intention of making some other country your permanent home, you give up your U.S. residency when you go. Once again, the USCIS will look to your behavior for signals that your real place of residence is not the United States.

On the other hand, remaining outside the United State for more than one year does not mean you have automatically given up your green card. If your absence was intended from the start to be only temporary, you may still keep your permanent resident status. Staying away for more than one year does mean, however, that you may no longer use your green card as a U.S. entry document. Under these circumstances, you must either apply at a U.S. consulate for a special immigrant visa as a returning resident or you must get what is known as a reentry permit.

Here's the problem: to keep your green card, you have to have the intent to reside permanently only in the United States. Canada requires a similar intent of it's landed immigrants. How can you intend to reside in both countries at once? If INS suspects that you no longer intend to reside permanently in the U.S., they can lift your green card. This usually happens during border crossings. The issue can also come up during naturalization: to become a U.S. citizen you must have intended to reside permanently in the U.S. continuously since the day you got your green card.

As a practical matter, you'll have some explaining to do at the border if INS finds out you hold residency in both countries.

Nevertheless, courts have held that application for and receipt of landed immigrant status in another nation, without more, does not establish intent to abandon permanent residency in the U.S. It is a significant factor showing that one intends to give up U.S. residency, but is not conclusive.

Here are some solutions:

Get citizenship in one country or another. With U.S. citizenship, you can reside wherever you'd like.
Apply for a Returning Resident permit. (For information on this permit, and other issues concerning Returning Residents, you may request an E-Mail report.) This permit diminishes---but does not eliminate---the chance that INS would be able to lift your green card.
Get a temporary work permit for one of the countries and keep the permanent residence in the other.

I would suggest land in Canada and maintain PR. Try to get your US Greencard through DV as there are relatively more opportunities in US. It also depends on your nature of work, availability of friends & relatives.

Congratulations on both fronts, Can PR & US DV. You can have both, with good planning.

Listen, the DV 1st letter is a notice and nothing is guranteed yet, but it is possible to have both. Go ahead and land in Canada and then wait for the second DV letter that is to follow.

By the time you conclude the DV process you would probably have spent close to 9 months in Canada (DV processing don't start until October anyway). After this, with a bit of careful planning and orchestrating you can fulfil the conditions of both and then you can make a choice at some point in time.

You can have them both but will not be able to maintain them both long term. If you want to keep all your options open in the first 3 years then land in Canada, follow-up with your DV and get your green card. Make a decision within the next three years which one works better for you.

my suggession is go for Canadian PR, now a day USA is worst, no more jobs, here no job then no inssurance for medical and no job no life, no respect from your own family members and relatives too, food is worst, americans are also completly jungli and worst people, no public transportation, if police will catch you and you are muslim then they ask lots of questions to you (personal experience, I drive with my friend he is muslim but I am not muslim , police ask us lots of questions about where we are belongs to, which is the our city in India, what is the birth place and what is your todays travel routes etc. and why you are going to on that route, uhh basterd cop). I rented home here and the rented appartemnt manager dont like us, when I paid rent to her she never said any formalities words like thanks, when other people like american or spanish mexican paid the rent she asked them how r u if they have kids ask for hows your kids and finaly thanks etc, even in appartment downstairs people dont like us we stayed upstairs of this appartment. Canada is nice, and al people are very friendly.
