Greetings! I hope many people are just as confused as I am about getting this application process started or where to begin. Angry Lips sealed

My fiance and I have been together for several years, and we have visited each other in our countries off and on. I'm Canadian and he's American. I'm 17 years old (I have parental consent Tongue) and he's 21 years old. We've looked into how we would be able to get married with a k-1 visa if I were to get married down there in Alabama, but it seems that getting married in Canada might be a little bit quicker.

My question is: which visa's would be suitable for my American fiance to come to Canada to get married? Would an immigrant visa be viable for such? All we're trying to do is speed up the process so we don't have to wait as long. Any help for a quicker time period, or a list of visa's that would be viable would be amazing. I've been so confused on where to start this process and which visa's to apply for and what would be quicker.

as a us citizen, your fiance does not need a visa to enter canada, nor to get married in canada. your fiance is what's called "visa exempt". he can simply enter as a VISITOR and get married whereever he wants in canada. All he needs is his passport to enter, and not to act or appear to be "moving" to canada. In order to work and live in canada legally, he will need to apply for permanent residency with you as his sponsor, and he will want to apply OUTSIDE of canada. Currently US OUTLAND applicants are getting approved in about 6 months time. He can stay IN canada as a visitor while his application processes, but he is NOT allowed to work! He is ONLY a visitor at this point, and will be until he is approved as a permanent resident. If work is an issue, you will need to spend the processing time apart, in your respective home countries, planning visits to each other until approval. There is no "quick" way to do it the right way. First you have to get married, and that's the "easy" part. All you will need to do is have him come to visit, apply for a marriage license and get married. THEN you can send in an application for permanent residency.

If we were to get married that way, would I still be able to apply for a green card (in the US) if it's not a US based marriage? The reason why everything is so complicated is because he has a daughter that he's planning on moving up here as well. What visa's would she need to be able to move up here?
 
I'm pretty sure you have to be at least 18 to sponsor.

i am not familiar with us green cards. i'd imagine the US recognizes marriages from Canada, so it wouldn't be an issue.

If he intends to move up to canada with his daughter, then she must be included in his PR application as an "accompanying dependant", so you would be sponsoring 2 people. She too is visa exempt, and will be applying for permanent residency. The child's mother will need to submit her approval to the move in order for the application to be approved, i believe.

as others have pointed out, you are too young to apply to be a sponsor right now.

I also know very little about US green cards, but I think you have been looking at the process wrong. What I know about K1 visas(from 90 day fiancé so not very much) they are to get access to the US for non Visa exempt countries, you don't need one to get married if you are visa exempt.

exactly, just like we can go to canada as a visitor and get married, canadians can do the same in the us, becasuse they are also visa exempt. my husband "visited" me and we got married in the states. our marriage is recognized in both countries.

the green card process is the us's version of PR, i believe. that's a whole other animal i know nothing about, and i think it requires more than canadian pr.
 
K1 Visas are to get fiances into the USA from VISA EXEMPT countries to get married and you have 90 days to do so.

My husband is Canadian, and we got Married in NYC. No Visa - No problem. Nothing needed.

He then used our USA marriage and is sponsoring me in Canada as his wife for permanent residency.

IF you want to get married in Canada, no problems either, he just goes to Visit and you get married.

However, you aren't old enough to sponsor someone yet. You must be 18.

Im planning on proposing to my gf very soon! Hence i want to know, after i propose to her and she becomes my fiancé, would be able to keep visiting her during out time of engagement or do i have to obtain a K or immigrant visa?? I dont intend to move or live with her now till we get married. ...been really stressful finding the right answers to this.would really appreciate everyone sharing their advice / knowledge or sharing their experiences
