Hello all,

I have the problem.
I'm principal applicant with my dependant child. My spouse is not accompanying with me because of the personnal problem. But he is also required to undergo the medical examination.
I want to know if it would be influenced on my application if the health of my spouse is not met to medical requirements???

lvtruong - From your timeline it looks like your application was processed quite fast at the beginning but slowed down after MR. Was it because of the birth of your little angel that caused the delay in the processing? Just curious to know. Thanks.

It is not a concern of your file processing either your ecas update or not.
It may happen sometime it may missing to update to someone's ecas.

So it is normal.

Yes that could be a problem if your spouse will not meet the basic health checkup by panel physician. You can consult with this matter with immigration lawyer...

Yes, adding my little angel and waiting for FBI PCC that took me sooo long. Actually I stayed in US for only less than 5 months totally but not sure why the VO forced me to submit FBI. So I had to apply for it and it took 4 months to complete the FBI PCC. Poor me...

The FBI PCC requirement doesn't sound right but the extra processing time due to your new baby was a fair thing. You guys must have been busy enough to not feel the anxiety caused by the delay. My belated congratulations to your family and have a speedy wrap up with the processing real soon.

Thanks for your response. Now it's my big problem. We are separated but not divorced yet, so the VO required me to submit the legal approve of separation, but in our country there's not something as this document except legal approve of divorce :(. So what can I do now?

Sorry to hear about the problem. From what I know before the divorce paper is officially approved, there is always sometime for the husband and the wife to settle their disputes/disagreements. Is there something in these documents that mentions you guys don't live together? Will the local authorities on your and your husband's side respectively confirm that the two of you actually live in different houses for sometime? I don't know the law there but you should try all the official documents possible as CIC won't accept your explanation without any proof. Hope everything will be fine with you.

I understand your situation. At this moment I do suggest you to go with your spouse medical either will accompany with you or not to avoid your delay file processing.

On the other hand if you fully confident that your spouse will not pass in medical then you have a strong background to get legal papers for your divorce from legal authority either marriage court in the mean time.

Always remember that you have kid and there will be issue on settlement and also you will have NOC to take with your kid in your custody when you will leave your origin to CA.

It is bit complicated at this moment and very time consuming process about your case and also your kids.

Please discuss with a good immigration lawyer and get suggest how you will get rid of this problem.

This is my advise from my little knowledge..

Thanks so much for all yours sincere advises, guys.
I'll try to have st. as a legal paper of separation, it's best way to solve the problem than to undergo un medical exam because i'm sure that my spouse will not pass in medical exam.
