Yeah Oscar7, it is a legal issue. It seems I will have to engage a Canadian immigration lawyer just to be safe.

[size=9pt] I doubt that should be the way ahead, what if the kids biological father has nothing to do with the kid's life. May be in such a circumstance one needs to show sufficient evidence that the biological father has no legal rights and doesn't take care of the kid. And then address this in the cover letter as well. This seems a situation where one needs to get opinion from legal experts may be...unless people in the forum have this experience to share. Good luck, mate!

Man this is so frustrating, I had applied for this stupid FSWP last year on time but it was declined due to incomplete docs ( I sent a copy of WES report instead of the original one). Now I sent all the documents but sent it on August 12, so got late!. This stupid residency issues are taking a toll on me. I am stuck with wait in my green card process for years in US and now here go my hopes for a canadian PR :|. Sometimes it feels if I should go back to India and live happily

Hi Experts,

I am applying for the FSW as the principle and including my spouse and my 7 year old step-son. Though am having a challenge completing the IMM0008. According to my wife the biological father of my step-son does not qualify as a "common-law partner" based on CIC's definition, because they hardly lived together. In fact my step-son's birth certificate does not indicate him as the father (its blank).

My questions are as follows;
-Should I mark the "Have you previously been married or in a common-law relationship?" for my wife as No?
-Do I still have to complete "Separation Declaration for Minors Travelling to Canada" (IMM 5604), since the father is an absentee father and cannot be referred to as "former common-law partner" as indicated in this form (IMM 5604)?

If the biological father does not qualify as a former spouse or common-law partner according to the definition you can check no.

Under normal circumstances, you (actually, the biological father) MUST still complete the Separation Declaration for Minors Travelling to Canada. He is not a former common law partner but he is still a parent of the child and is non-accompanying and therefore must consent to your step-son immigrating. However it is possible that the biological father is not legally considered a parent in their own country. I don't know how Canada would handle that. There is an international treaty concerning the transportation of children to other countries without a parent's consent and Canada is a party to that treaty.

I suggest you get the biological father to fill out the form if possible. If he will not co-operate, you may be able to get around it, but at that point you would need the help of a lawyer to help you apply without it and make sure you have all your bases covered. Do not go in unprepared on this.

How do differenciate a WES report copy from the original? I got in the WES envelope 2 papers exactly the same.
Or did you mean that you send a photocopy?

the VO sent me email requesting PCC from Angola. a country which I am not residing in now. However, my communication with the embassy of angola in Dubai proved that I should be in angola in person to apply, which is hard since entering Angola is hard without a job offer of company invitation.

Do you think it is enough o write the VO saying this?

In this case I believe her son's father may need to Sign a consent letter as acknowledgement, and you may not need to fill said form; Lets hope other seniors can shed more light on this.

The form clearly states that it must be filled out by any non-accompanying parent.

Why do you say you "got late." All the NOC caps seem to be still safe. What is your NOC?
