Hi,
I got married to Canadian citizen while on work visa in US,came here as a visitor
applied on spousal sponsorship
inland application recvd at vegerville=Sep3, 2008
transferred to local Calgary office=March10,2009
Misplaced for 8-9months,went to Mississuaga by MISTAKE_:)
Received at Calgary office=Dec. 2009
Calgary office sent a letter in Dec 2009 stating that due to high work load,application recvd in dec2009 will be reviewed in August2011.
so it would be almost 3 years if i may hear something from them.
what should i do?
I am so upset,i could no visit my family back home since 2 years.I have few months old baby and my parents and siblings could not see the baby yet.I have a doctorate degree in science and could not work since then.
should i withdraw my application and apply from Buffalo(while still reside here)?what will be the procedure,please do mention positive and negative both points.thanks

The mistake you made, probably, was applying inland without proving that you had valid temporary status in Canada. I know, everybody reads the Feb 2005 legislation note in the inland sponsorship guide and forgets everything else that's written there about having to maintain valid temporary status and they think they just apply inland and all is well. And it's not.

Once your application goes to a local office, the timelines are huge - as you found out. Any area with a high influx of immigrants will be experiencing this type of delay. You certainly can withdraw the inland PR application and reapply outland - you understand, though, that you will have to undergo new medical exams, get new criminal clearances and pay new fees (except the $490 RPRF). What I don't know is whether or not you are eligible to have your application processed through Buffalo. If you still have a valid work visa in the States, then possibly yes. But if you've been in Canada since Sept 2008, I doubt you still have valid status in the States. So, in that case, your application would be processed at the embassy that represents your country of birth or permanent residence. Since I don't know which country that is, I can't tell you what the processing timeline would be for an outland application. Some overseas embassies process relatively quickly while others can take as long as it would take your inland ap to be processed in Calgary.

If you reply and let me know where you're originally from, or where you have permanent status (if somewhere other than your birth country) I can tell you how long you can expect to wait for PR via the outland process. The other issue will also be what you do to restore your temporary so that you're not in Canada illegally - if that's even an option for you at this point.

If someone has legal status in Canada as a visitor, who then applies for PR as a sponsored spouse from in Canada.

Can she then apply for a work permit while the PR/sponsorship is in process?

If the whole process takes up to 2 years in land, would they approve work permit application?
