Bro, restoration application should include an LMO, right? Correct me if i'm wrong but that's what I know. Is her LMO still in process too? Some people would sometimes advise that it is better to have separate LMOs / WPs so that you will have more options. But if she doesn't have any hope of having her LMO approved then I guess that leaves us to your LMO and WP alone. If you include her in your restoration and WP application, I am not sure if that automatically means she will be granted an open work permit.

I came here in Calgary with an Open Work Permit and when my husband applied for his WP, it included me as well. I think you should ask a consultant about this because all of us in this forum actually applied for our Open WOrk permit from the Philippines. I'm not sure if anyone here can answer your questions because we do have a different situation considering that you are both already in Canada.

simula ng maging member ako dito i always include everybody in my prayers...

and by the way a friend of mine is asking kung meron na ba daw nag file sa cem na as in walang degree? yun bang HS level sya at no college dgree? or she asking possible din kaya daw mag apply pag ganun ang case? or my certain requirement ba sa spouse from school credentials? sana somebody can answer para makatulong tayo sa worries and queries nya...salamat ng madami...

Hi! Don't worry about the credentials kamo. Ang tinitingnan naman talaga is occupation ng spouse nya sa Canada. Dito din naman sa Canada hindi nagcocollege ang karamihan. Tinitingnan lang ng CEM is yung ties ng spouse (whoever is applying) sa country nya. eh knowing the culture, alam ng mga VO na may ties tayo sa Philippines. Kaya sabihin mo as long as skilled ang hubby... apply na. :)

Hi.... You said your WP is still valid but you're gonna file restoration of status next week?.. When is the validity of your WP? Do remember that you can only file restoration of status within 90 days AFTER WP expiration...

Also, I agree with ailooney that positive LMO is a vital requirement for the Case Processing Center-Vegreville to consider your application for restoration of status...

As to your main concern, I think your marriage does not make your wife automatically eligible to appy for an Open Work Permit. That does not as well automatically change her status of stay in Canada. She can apply for it being your spouse once you get to qualify (if your job falls under NOC A, O or B) and your WP is valid for the next six (6) months.

Bro, since your LMO is on process and your WP is still valid, apply then for WP renewal (if same employer), or New WP (if new employer). You indicate the LMO file number in your application for WP. The said move will give you implied status until you receive the decision on your WP application. If approved (that, we pray), then your wife can apply for an OWP even from within Canada. If her restoration period is about to expire on Feb. 2 and no progress yet on your WP application, then she has to apply for change of status to visitor to legally stay in Canada while waiting for the outcome of your application. But, let's pray that she also gets to have a positive LMO prior to Feb. 2 and apply for restoration herself.. You may want to ask your employer to make a follow up with the HRSDC.

By the way, consider the processing times in the CIC website.. The processing for WP applications, be it online or paper is getting faster and faster. When you filed WP renewal without LMO, the CPC-V must receive your positive LMO before the decision on your WP application is to be made.

Good luck, bro... I suggest that you consult experts on this because you have a different case... Or you may want to tell us more of your situations so we can help you better. Pray always and have faith... God knows what's best for all of us...

Pero iba ata yun sa case nya, di ko lam if tama advice ko, mas best talaga if magconsult si bro.. Thanks, sis... Keep on praying.. Sana maaprove na un LMO ng hubby mo sa same employer.. Yun hubby ko kasi kakalipat lang ng work kaya wala pa sya kakilala matatanungan sa position ng hubby mo.. Keep your faith, girl.. Maaayos din lahat.... ;)
 
hi po sa lahat ..n pickup na po yung documents nmin just today hayy kakakaba pla mg wait ng results he he pero i have so much faith na magiging ok lahat (sana nga he he) ask ko lang po f san mas mganda mgpa medical kse yung husband ko before s Nationwide as well as dun sa iba kong kakilala.. nbasa ko kse na sa St.lukes mlalaman mo results within the day tama po ba since dito kmi sto tomas batangas pa sana alam ko agad f my test na dapat ulitin para m pgplanuhan at wat po rate nila for adults and kids medical... thanks po! gudluck sa mga ngaantay ng visa im sure on the way na yan he he and congrats sa mga n grant na !!! godbless to all!!
