Hi.... You said your WP is still valid but you're gonna file restoration of status next week?.. When is the validity of your WP? Do remember that you can only file restoration of status within 90 days AFTER WP expiration...
Also, I agree with ailooney that positive LMO is a vital requirement for the Case Processing Center-Vegreville to consider your application for restoration of status...
As to your main concern, I think your marriage does not make your wife automatically eligible to appy for an Open Work Permit. That does not as well automatically change her status of stay in Canada. She can apply for it being your spouse once you get to qualify (if your job falls under NOC A, O or B) and your WP is valid for the next six (6) months.
Bro, since your LMO is on process and your WP is still valid, apply then for WP renewal (if same employer), or New WP (if new employer). You indicate the LMO file number in your application for WP. The said move will give you implied status until you receive the decision on your WP application. If approved (that, we pray), then your wife can apply for an OWP even from within Canada. If her restoration period is about to expire on Feb. 2 and no progress yet on your WP application, then she has to apply for change of status to visitor to legally stay in Canada while waiting for the outcome of your application. But, let's pray that she also gets to have a positive LMO prior to Feb. 2 and apply for restoration herself.. You may want to ask your employer to make a follow up with the HRSDC.
By the way, consider the processing times in the CIC website.. The processing for WP applications, be it online or paper is getting faster and faster. When you filed WP renewal without LMO, the CPC-V must receive your positive LMO before the decision on your WP application is to be made.
