Just because you have this opinion doesn't mean it's accurate. They may not log acceptance until they are prepared to deal with the application directly. They may not consider the backlog "received." Did you ask the office about this?

Amikety

I think the agent said something like "it should be in the system 5 days after the application is received". But the agent then told me to call back in a week.

Hi Freshman,

2 1/2 weeks isn't a very long time yet. It took about a month for them to send me a letter back to say they didn't accept my prints and to resubmit another set. I sent mine through UPS and got a tracking number because I like to be able to see and verify that a real person signed for it but then I still had to wait, and wait...and wait some more.

NicAnn

It has been almost a month. I called FBI and the agent cannot find me in the system. She told me to call back in a week. For now I guess I will call back and then decide what to do next.

I am thinking about even submitting the application without the background check.

We are thinking about this also. We have submitted my prints and gotten a form letter that states that my prints were not acceptable, so we are going to include a copy of that with the application and say that we are still working on it but are having some trouble with it. Someone (somewhere here, forget where) said that it is possible to send the FBI report later, I guess because many people have problems with unacceptable prints (maybe?) and that at least they can start on that application process. Then once we get a file number we can submit the FBI report with that file number so they can merge it with our application...if anyone knows this would pose a problem, or has had problems regarding this, please post about it. ;)

FBI charged my credit card today. Now I know they have my application! I think they received my application a month ago. So at the moment, it looks like they start processing a month after the receipt of applicaton. I called them on the third week and they have no information of me. The automated voice on their phone did say that they might not be able to give you any information until after the 4th week. At least now I know the automated message on their phone reflects the truth.
Thank you all for advices last week.

That's good news, Freshmen. Each is a baby step ahead. Before you know it you'll be residing in Canada with your loved ones. These little bumps in the road and the problems we must endure, will make the future (hopefully) acceptance that much sweeter. :)

NicAnn - thanks for the encouragement. I am applying inland, so I am already with him :) (I appreciate this opportunity everyday). I am sooo looking forward to the day I can go back to work though.

Oh, ok. I'm doing it outland.... first. It's so difficult. We are doing it this way so I can continue to work... which after we get the application in (we are shooting for the end of this month) we may convert to "inland" after we get sponsorship approval, we hope after about 3 months (?..I hope, because this is torture). Then I won't be able to work either until everything gets processed, unless I can cross the border to work in the US. I've heard mixed reports from border agents. Some say I will be able to cross back and forth and others say if I leave Canada at that time, I won't be able to reenter. Sigh.

Inland is processing at 6 months for Stage 1. (8 months for Stage 2.)

I'm also thinking about swapping to Inland. The need for me to be able to work is becoming super pressing.

You're allowed to travel with an Inland application. The risk is if you're denied re-entry. CIC will consider your application abandoned if you're denied re-entry. The chances of being denied as an American are low - especially if you travel with proof of the pending PR application. However, the more you cross the border, the higher of a risk you take. It's up to you, really.

There is a way to counteract your application being abandoned, but I don't remember what it is. You'd probably have to contact a lawyer - fun.

I wanted to apply outland as well but we didn't wanna be separated after the wedding. Either way there are sacrifices I find. I wonder why Canada doesn't have fiancee visa option as the US.

Because that would be the number one avenue for scams.

The U.S. is rethinking their fiancee visa program, as it's proven to be a major source of immigration fraud for them.

Really? Well yes, that makes sense. There are less ties and it is definitely more convenient. It's either conjugal or common-law in Canada. We are not qualified as conjugal partners, so we had only one option.

Got another rejection letter this week. Went to local police station to get more prints....and the officer said in his 12 years as a police officer mine are the worst prints he has ever seen. :(

Does anyone know if there is another way of obtaining the FBI records? Can they do it through social sec. # if prints are illegible? Is there a way to talk to a real live human FBI person at the FBI office?

That sucks to hear. I got mine back today.

I might call a lawyer's office and see what they have to say.

For FBI clearance you need to send fingerprints. Here is the contact number: CJIS Customer Service Group at (304) 625-5590.
