I am hoping to get some information on extension of stay applications, I am here from U.K my fiancee is sponsoring me we've applied for an extension of my six month limit two months ago and asked for 3 months extension so we could spend summer together before I return to U.K and start outbound sponsorship, we have since discovered we can ask for extension to remain together during outbound sponsorship and would like to request that, can we now submit another extension application for permission to remain here while the other is pending?

What are the chances of being refused entry back into Canada if my fiancee and I were to leave for Mexico or America for a trip, if we left for a holiday and returned I would have another six months visitor visa to get our affairs in order, at the minute we are to the wire of time limit, has anyone done this and what would happen on re-entry, can they refuse me and I would remain stck at the border or have to take a flight back to U.K, is this allowed?

You would clearly have a dual intent to re-enter Canada...which is perfectly legal. One as a visitor and one to continue cohabiting with your fiance.

The issue would be if the CBSA officer that is assessing you begins to question you regarding your dual intent. You may be asked to provide proof of strong ties back home in The UK, since you cannot legally `live' in Canada yet. Even with your joint lease, you are still a `visitor' in Canada.

Seems so counter intuitive though to be at the same time as being asked to prove the validity of your relationship and intent to stay together and start a new life here that you need to show you still have strong ties in a country you have decided to leave....difficult to comprehend but I understand thats the process.

That truly is the epitome of dichotomy:

In the eyes of CIC, you must prove that your are living together.

In the eyes of CBSA, you must prove that your are visiting Canada.

The simple facts are that I have no intention whatsoever of staying here illegally or beyond what is permitted, my son is 3 and requires school and access to medical/dental etc. We would like to remain here together as much and as long as possible as the Province is Quebec and it is vital that my son and I learn as much French as possible and immerse ourselves in the country before he starts school(will be French school) however, if denied we will return to U.K and if we really have to my son and I will reside in U.K for the entire duration of the process but it will really set him back especially for schooling here.
