Express Entry Details: Spouse already a Permanent Resident in Canada

Hi, I'm married and my spouse is already a PR holder in Canada.

However, I am applying for immigration on my own through Express Entry. Now I have received an ITA recently, and I need to confirm my details to go ahead with the application.

My question is: should i select YES or NO to the question "Will your spouse accompany you?"... I have selected NO, given my spouse already lives in Canada.

Can someone please help? I'd appreciate it very much. TIA.

You can answer no and include a LOE regarding the fact that your spouse is already a PR.

I am married to a PR and on my application for EE - FSW, I said yes to the question about if my spouse will be accompanying me as I wasn't sure how to answer based on the fact my Wife who is already a PR is living with me in Canada already while im here on a PGWP. Now that I have gotten my ITA I see where they are charging me double the fees, one set for me and the other for my wife. But should we be paying PR application fees for someone who is already a PR?

If not, I am wondering what I should do, modify my initial answers to say 'No' to "accompanying spouse" and do the LOE to explain? But what then of my ITA will it be voided if I make such a big change to my application? I don't think my points will change as the table had 0 CRS points from my spouse anyway.

Any advice would be greatly appreciated.

Hi the consultants are discouraging the spouse of a PR to apply in Express Entry saying that their file shall be put on hold and question would be asked as to why are they not applying for sponsorship. They are saying the spouse of a PR should only apply for sponsorship. Is there any merit in that ? Please anyone who can guide in this matter.

Change it to non-accompanying, you will need a LOE about your spouse's status and proof (scan of PR document).

No, that is not true, many spouses of PRs obtain their PR status through EE. The only thing is that the EE system is not tailored for that.

Meaning, the EE system assumes that if you have a spouse, he/she will also be applying for PR with you. So the system is designed for that and doesn't tell you what to do if your spouse is already a PR/citizen.

Yes, that may very well be true, because speaking from my own experience - I have applied through EE while my spouse is a PR already. I selected no to "spouse accompanying" question and attached an LOE, as was suggested to me (above by Delpiero07) and applied.

Got my AOR - however initially, my application showed me as a primary applicant and my spouse as a secondary applicant. I later got an ADR asking for my spouses medical to which we wrote to them and informed them that my spouse is already there, and subsequently the application was updated and secondary applicant field was removed (hence, leaving only me as a primary applicant).

Hi, can you please guide me if spouse is shown as not accompanying as he is a PR, then the primary applicant would be still be required to upload all the information regarding the PR spouse like passport scan, work history, travel history etc ? Any help would be really nice.

Hi,

I recently got married in India in the month of August 2018 and my husband holds Canadian PR status since February 2018. He was in Canada for 2.5 months till the end of April 2018 and had to come back to India in the 1st week of May due to an emergency in family. He has already got his PR card.

Currently, We are living together in India and are planning to move to Canada after I get my PR. I plan to apply for PR under Express Entry program as it is relatively faster and would allow us to live together till we move to Canada.

I am eligible to apply under EE program and if everything goes well, my CRS score should be around 460.

Immigration consultants are discouraging us to apply under Express Entry Program and are suggesting to apply under spousal sponsorship program only. But that is a longer route and I believe that my profile is well suited and eligible for EE program.

Please suggest:

1. Shall I proceed and apply under Express Entry Program or not? Will it risk my chances under Spousal Sponsorship program later on in any way?
2. What shall be our answer to the question “Will your spouse accompany you to Canada” ? (Husband is PR holder but is currently living in India with me)
3. My Travel Visa was declined earlier in this year when I was single and had an invitation letter from a friend who holds Canadian PR. Will this TRV rejection have any bearing on my PR application?
4. Does my Husband require to produce documents like PCC and Medical again? Will he be required to re-appear for IELTS again (His IELTS result is expiring in February 2019)?

The consultants are misleading you.
There is no such compulsion for you to apply under spousal sponsorship.
1. If you meet the eligibility requirements, you will get through express entry, so no question of spousal sponsorship issue.
2. Mark husband accompanying '''No" as he is already a PR.
3. Shouldn't be a problem.
4. Since your husband is already a PR so the answer is No.
