Expired visa and FBI info

Hi all! Im so glad to find this forum, maybe I can get some answers finally.

Ok, hope someone can help. I am from Sweden but have previously been to the USA twice for work and studies on a J1 visa (1 year each time). I am currently in the USA on an expired Tourist visa (which I am not proud of). I am married to a Canadian and we now want to move to Canada so I can work and basically so we can start a "normal" life together.

Question 1: Do you know If I am able to apply from the USA or do I need to do it all from Sweden?
Question 2: Is it possible to send in my application now and later the FBI record, since that takes a long time to get?

hello Fia,

if the FIRST time you entered the USA was on a valid 1 year work/study permit - then yes, you can apply outland through the BUFFALO visa office.

the FBI does not have to be sent in to the Case Processing Centre in Mississauga, ON - however I would strongly suggest providing proof that you have requested it (receipt payment/courier tracking number of the submission) and a written statement that explains you will ensure that the results be sent to the federal visa office upon issuance.
