Exclusion order while waiting?

I have submitted an outland application while being out of status. Can I be given an exclusion order? If asked to leave will my application automatically be scrapped ? So afraid to live in my house incase they take me away

You started a thread here awhile back asking about this and received some good answers, but NOBODY can guarantee what (if anything at all) will happen.

Don't hide in your house; get out and enjoy life. IF CBSA is going to do anything, there's really nothing that you can do about it by staying inside.

I congratulate you on finally submitting an application. Focus your energy on that positive step and leave the rest of it alone.

An outland application offers no protection against being sent home. However it is not automatically cancelled as a result.

I am so sorry to hound you with this my fear i can't switch off in have been admitted to hospital twice with panic attacks had to pay 2200 dollars and it's getting worse. Sorry here seems to calm me some what.

Try a different approach friend. Imagine the worse situation to happen and imagine what you will do to survive and overcome it.

Just close your eyes and say " if I am picked up, I will cooperate with CBSA bearing in mind that everything that I say or do can and will be used against me. So I will be apologetic and as humble as pie. Being picked up does not constitute automatic refusal so I will remain calm. I love my wife and she loves me and will not abandon me. As long as I am humble there still can be a bright future in Canada for me god-willing. "

So sorry you are experiencing this. Agree with pp... ask yourself what is the worst that could happen? They can send you back home but it's not the end of the world. You applied 'outland', so even if you were sent back home, I don't believe it results in automatic cancellation of your application, unlike if it was an inland app where you are expected to be living with your spouse.

Speaking of this, what did you put for 'status' when you applied?

Any particular reason you didn't go with inland instead and remain in Canada throughout? You may have been eligible for an open work permit at some stage.

Lastly, try to focus on other things(e.g. volunteering at local church or shelter) so that your health doesn't suffer so much. Are you able to get insurance to cover unexpected visits to the hospital? I think the premiums for a year, might be cheaper than $2200.

I don't know if you are are religious, but here are a few bible passages I find helpful in such times: Romans 5: 1-5, Ephesians 4, Philippians 4, James 1, Psalms 27, John 14:27. Youtube also has good sermons about peace, worry, etc from Pastors Creflo Dollar, Joel Osteen, T.D. Jakes, etc.

Oh I think I have made a huge mistake I don't know what to do about my health it scares me i should have applied inland. Your words are comforting but should I withdrawal my outland and apply inland?

I can't tell you what to do, but before doing anything, I would ask yourself:
1. how long has it been since you applied?
2. what benefit will switching from outland to inland bring at this point?
3. being out of status, if you went with inland, would be eligible for an open work afterall?
4. the wording of the inland PR has changed with respect to people being out of status (Ponga can elaborate more). If I remember correctly, it used to be that if there was an inland app in process, CBSA wouldn't/couldn't begin deportation proceedings but that has changed now.
5. would it be better to return to home(UK) with your son and wait it out there (you will likely need your partner to provide a written and signed note authorizing you to take the child outside Canada)? This removes the stress of constantly watching over your shoulders. As you are visa exempt, may be wait a couple months then try to re-enter. If allowed, you become in status again and have 6 months legal stay and be sure to apply for renewal this time at least 30 days before expiration (you can apply online or via mail). Ofcourse, this assumes you are let in without any issues and they don't realize you overstayed.

Whatever you decide, hope it works out ok.

I would just stay with the outland application. Outland is generally much faster than inland, though it depends on your visa office. If you do have to leave, an outland application will not be cancelled because of this. An inland application would be cancelled if you left and could not get back into Canada.
Through the London office, you will most likely be approved soon.

Inland takes forever. Outland is best. I wouldn't advise you make any changes without consulting a smart and helpful lawyer who knows how CIC operates. An immigration consultant and an immigration lawyer can be the difference between eating at McDonalds or the cn towers revolving restaurant....but not always....so let the buyer beware.

Also to let u know... My hubby was very evasive when he was picked up by cbsa. If he was calm and apologetic he would have been able to visit me after his exclusion order expired. He was scared too....but being as humble as pie would have been better for both of us on the day they picked him up.

Well i don't really have any cute words or anythibg because I'm not really good at thay stuff. All i can say is You can either literally kill yourself from anxiety because you think immigration will show up at your door tomorrow and throw you in handcuffs and ban you from Canada forever.... or you can relax and cross that bridge IF you ever get there. I've been here a year and a half. Nothing has happened yet. If it does happen then I'll deal with it then but I'm not trying to die before PR happens because I've fret myself to death or live in a prison that I made in my mind because I think someone is going to collect me from my bedroom and throw me out. That's how I've dealt with it. I realized that I needed to stop thr fretting once I started to get sick.

Be positive, however be smart if it happens. Act appropriately and be appologetic and know it is not the end of your PR dreams. And remember that how u act and what you say will be recorded on your immigration file. Get legal advice on how to move forward to avoid any regrettable mistakes moving forward. Also if you dont have a work permit, remove all evidence that you are working(I.e. all papers, business cards and electronic proof of income)
