This ONLY pertains to an Inland application. Effective August 1, 2014, Citizenship and Immigration Canada has changed its definition of a dependent child for its immigration programs. You can apply to sponsor your spouse, common-law or conjugal partner, or dependent children to immigrate to Canada. It does not matter if they live in or outside Canada. If they live in Canada, they do not need to have legal status to be sponsored.
Your family member must have medical, criminal and background checks. If they have a criminal record or are a risk to Canada's security, they may not be allowed to enter Canada.

I would just leave the outland app to process and live your life. There is little chance that CBSA will come knocking on your door and you will be a PR in a year or less.Help22 said:Decided to withdraw my outland and go inland.

I asked a hypothetical question based on this story the last time I spoke to a Call Centre agent, citing that there has been much debate over this. The agent seemed very knowledgeable (hey...I got lucky) and was very adamant that a person without status should NOT submit an Outland application. No one really tell you if CIC will tell CBSA or if CBSA will take action. There have been a few people out of status who've applied outland recently without any issues.
At the end of the day, if CBSA becomes aware, it's not an immediate "Get out". You have a Canadian child and a Canadian partner and CBSA doesn't like splitting up Canadian families. Your partner can ask his MP to intervene or even go to the media.
