If they check addresses you've lived at and cross reference that with anything were your ex's name comes up....you will be screwed! They will ask questions and want answers....or they can outright decline the app

Honestly it's not worth it to risk it but if your a gambling man then do that. I personally think it would be stupid not to be honest

I know he's doing the wrong thing, but as he said: they don't even had a house rental with his/their names.
Is that common? To check adresses and cross information?
Actually I don't know if CIC could discover such a thing since they don't have any in common (legally speaking).
For example, in Brazil (place that I live), it's common to rent a house and the bills come with the owner's name.
Try not to lie, but do what's the best for you anyway.

What if they call your wife for an interview, and ask a question about your past. She says something angrily about your ex. Busted.

There was another member her once who did a ceremonial wedding with a former spouse, no documents. CIC found out and charged her with misrepresentation.

No one is going to encourage lying. Tell the truth. If it upsets your wife that much, then don't show her the section where your ex's name is listed.

This is really simple. If CIC thinks you were in a common law relationship and you didn't report that, that is all. You now have to PROVE to CIC that you were NOT in a common law relationship. Good luck explaining to them how you lived with a woman for 5 years, but you were only 'room mates'. The burden of proof will be on you in this case to prove you weren't.

Tell your wife to suck it up. If you hadn't had this relationship with your ex then you wouldn't have been in the right spot to meet her. Tell her she doesn't have to like the ex, but she has to accept the fact that it happened and needs to noted on the application if either of you wish to succeed in this endeavor. Any time you are willing to 'lie' to get something you can expect that it will come back around and bite you square in your hind end.

If your wife still refuses then I certainly hope she is willing to go back to your home country to live with you while you serve out your 5 year ban for misrepresentation.

I was talking about your case in another forum and I really doubt they could discover something like this.
See: I'm not telling you to lie, but if you're 101% sure that you and your ex don't have ANY documents signed together, there's nothing to worry about it.
CIC is not Interpol.

I read all replies and became curious.
if you lived with your bf/gf for a year and did not anything according to cic guide line ( no co-sign rental agreement/ no joint account, file tax refund separately etc) except his/her address was same as his/hers while they lived together.

Are they common law or lived together as bf and gf?

The difference between common law and lived as bf/gf is kind of unclear to me.

Seems like allmosthere1234 was not common law with her (if he did not do/sign anything with her).

Why he can't just live together with someone as a roomate for 3, 5, 10 years?
That's nothing wrong from my perspective.
Buuuut I understand the forum members when advice to not lie. It's the safe way.

but if I dnt have any signed paper with her and I dont wanna disclose this, they will be not able to discover that she was my girlfriend am I right?

You're not listening.

You don't need to have any paper (signed or otherwise) to be common-law. You usually NEED these papers if you want to prove common-law to CIC when you are applying WITH YOUR CURRENT COMMON-LAW PARTNER.

Just because you don't have any papers proving that you were in fact common-law (which YOU WERE) it doesn't change the FACT...that you were.

You have two choices:
Disclose the previous common-law and deal with your wife freaking out about it (which really does sound ridiculous)- [Yay...right decision]!

or

Not disclose it and wonder...'What if' with each passing day, while you wait for a decision on your application. - [Booooo! Bad decision].
