Hi. My employer is refusing to provide job offer form, because they think it is equivalent to them sponsoring my PR application. They have explicitly stated in my employment agreement that they do not sponsor PR applications.
I have explained to them the differences between LMIA and PNP. LMIA seems to be more like a sponsorship because the employer applies on behalf of the employee. PNP just requires a verification that I have a valid job offer from a valid BC employer.
But still they refuse.
Is there anyway else I can try to convince them? Anyone has prior experience with such a situation?
Any tips are appreciated.

Well technically, if your employer signs the job offer form, they are signing for consent to release confidential documents to BC PNP such as financial statements, corporate tax returns and what not.

You might need to find a different job if your current employer is still refusing too.

Their take is: "We are an equal opportunity employer and are willing to hire anyone legally allowed to work in Canada. We have no preference for nationality"

Will this answer be acceptable to BC PNP?

Nope. That doesn't in any way address the question that's been asked.

He should simply answer " Because we didn't come across any qualified job applicants who are Canadian PR or citizens."

Or "there wasn't any Canadian PR or citizens applied for the job". It's not their fault...

My employee also don't want to sign the paper form. Is there any update on this topic? or Is there any proper way to force them to sign this paper ? BczI've been working for 2 years for the same company under noc A code and I'm happy to work for this compnay but they avoid to sign this paper due to they don't know anything about immigration processes. Maybe lawyers can explain that to them very well, right? Please let me know if you guys know anyone (lawyer,consultant) who worked on this before.

There is no way to force them. It's their choice whether they sign or not.

You can certainly hire a lawyer to help explain the program to them. However there is no way for you to force them to sign. They are under no legal obligation to do so.

Many large companies will not sign these letters and it's not because they don't understand immigration programs. It's just against the company policies to sign these types of documents.

I also heard that we can apply with additional supportive documents(such as employment letter, paystubs, a reference letter written on plain paper by a senior colleague ) if the company don't willing to sign paper. is this true? I mean of course if I apply with this way, this will be initiative of IRCC

You can do that for Express Entry. However if you are applying for PR under a PNP program that has an employer form, the form is mandatory. Which exact program are you under? I probably should have asked that question first.

If you are submitting PNP , your employer have to submit employer declaration form . He need to sign that form . Even if you submit application without it , your application will be refused.

You mean additional supportive documents wouldn't be enough?
