Doubts - Permanent Residence by Sponsorship - Currently living in Canada

Hello Everyone!

My name is Daniella, I am a Brazilian citizen, married to a Canadian (citizen by birth) since December 2013. I have a multiple entries visitor visa and we are living together since September 2013 in Thunder Bay - ON. We have no dependents, and we already have most of the documents required on the form IMM5443E Document Checklist .

We started to fill out all the forms for Permanent Residence From Within Canada - Spouse or Common-Law Partner in Canada Class (IMM 5289), but we're a little confused.

My questions are:

1) My husband needs to be previously approved to be my sponsor? He needs to fill out a different application before I submit mine?
2) Specifically what fees need to be paid for our situation?
3) As we live in Thunder Bay-ON, to which office should we submit our application?

I will really appreciate any help!

1) your husband has to fill out his application forms and along with yours. A completed applications contains both your husband and your application completed and signed. You cannot send your husband's application first then yours. Doesn't work that way. The application will be sent back as "incomplete" applications. Also add the OWP application along with the PR sponsorship papers. This will allow you to get "implied status".

2) assuming OWP is sent with application:

sponsorship application: 75
Principle applicant (you) : 475
Right of PR free: 490
OWP application fee: 150

Total: 1190

You don't have to pay the right of PR fee 490 up front but would make the processing easier on yourself.

3) you send your application to vegreville CIC office for inland application.

Just to clarify, what's the difference between CPC Vegreville and CPC Mississauga? On the CIC website was not very clear and I was curious, because I am living in Ontario.

Another question I have on the IMM0008ENU_2D Generic Application is about the question 10 (current country of residence) of the Personal details section. I have to write From/To I am staying in Canada, and I really do not know what to write, because I am not leaving Canada before I submit my application or until they give me a return.

My multiple entries visa expires only in June, 2018, my last entry in Canada was in September, 2013 and as a visitor I cannot stay here for more than 6 months uninterrupted.

What should I write then?

All outland applications are sent to Mississauga. All inland applications are sent to Vegreville.

Scylla is right. Stage 1 for Sponsorship of spouses living outside Canada is being processed in Mississauga and for Sponsorship of spouses living in Canada is processed in Vegreville.

For 10. in IMM 0008, I wrote what's on my work visa, My work visa is good from 2012 feb.xx till 2015. feb.xx. So yours should be 2014 February (6months from your initial visitor status started), and you should apply to extend your visitor status..
Also, make sure that once you apply for inland application, you are not allowed to go out of Canada!

Any documents that doesn't have any english/french in it, must be translated. The translated document must be original, certified and notarized.

I'm not sure why you have a visitor visa valid till 2018? I've never heard this of this before, or is it a visitor's record?

How long did the border officer say you are allowed to stay in Canada for? Did he/she mention a date or make any remark in your passport? You should put the date you are supposed to leave to country - which is 6 months after the arrival, because legally this is the date you are allowed to stay till. You will get it renewed later on.

Also, have you considered applying for a work permit at the same time with your application? If you apply inland, after the first stage approval you will be allowed to work, if you send a work permit application together with the PR one.

As the OP said, it is a multiple entry TRV. They can be valid for up to 10 years, depending on the expiry date of an applicant's passport. It allows a person to re-enter Canada multiple times without having to reapply for a new TRV each time. Yes, that is my current situation. I have a multiple-entry visitor visa valid until June, 2018. My last entry in Canada was September 20, 2013 and the officer did not stamp anything in my passport indicating a date that I must leave. I married my fiance who is a Canadian citizen in December, 2013 and would like to apply for PR inland.

Do I need to extend my visitor visa if applying for PR inland?

Any help would be greatly appreciated

By what date at the latest should I answer question 10 of the form Generic Application Form for Canada [IMM 0008]?

If you are not leaving Canada then put the day you got here in the from section and the date you sign the application as your to date.

Hi Daniella

The dates to fill out at this form are the date that you entried in Canada and the date that expire your visitor visa.
About translations you have to send all of your docs that aren't in English or French; birth certificate, and polices certificates.

Excuse me people but I will write one sentence in portuguese language about brazilian policie certificates so it will be easy to me explain that to Daniella.

About to extend you Visitor visa it is up to you. It is not a obligation to the ones in sponsorship inland application. But if you feel more comfortable carring some status, you can renew.
