Do I have right to sponsor my nephew in this situation ?

Hi all people here. As the instruction from CIC I have right to sponsor my relatives, but in my sittuation below?
My sister is window. She gave her son to my mom took care him and she left the country married a chinese guy since her son was 3 years old. she stayed in China and abandon her son because the chinese husband did not want to bring stepson to his family. Now he is 11 and my mom is 75 years old still taking care of him by my money sending back home. But the problem is when she is tired and sick she can not cook for him and she is trying to let him stay at orphan centre ..ect anyway it is hard but I think I can take care of him if he is in here. Can I have right to sponsor him to live with me in Canada ?

Somebody here give me hints?

Which country are you from ? do you have other sisters or brothers who is living closed to your mom ?

Since your mother is still alive - no, you cannot sponsor your nephew.

You could try adoption. However you'll have to prove that the adoption wasn't carried out for the sole purpose of facilitating his immigration to Canada.

It doesn't answer your question but at the same time if it's just to provide a relief for your mother, you could simply hire someone to do the housework. This might cost you not more than $150-300/month at max (dependng where in China). This is most likely not much more expensive than bringing your nephew over to Canada...

if my mom go to " CARELIVING-HOUSE FOR OLD People to live " then my nephew will be in orphan centre. if in this situation ... what can i do? adopt him or sponor under orphan catergory. ?

You can certainly try to adopt him and see what happens. However he's not an orphan. His mother is still alive.

If the mother were to go to an old age home and the nephew was essentially living in an orphan home, could this become an application for Humanitarian and Compassionate grounds?

Yes..It is hard for me. I did not know how to define what cartergory he belong to ? His mom; my sister is still alive, but she abandon him since he was 3 years just because she can not ruin her new family in china since a chinese guy accepted to married her even she was window. She can not bring him from Vietnam to China without his consents that is why my mom took care him since that day. but my mom getting old she can not take care him anymore...she may go to the careliving house and she will give him to orphan centre like many people did if they did not have ability to support or take care their childrens and they give them to the orphan centre.

SO as your advices. I take him as adoption way is the best ?... now I try to researh how to adopt a son from other country especially the agreement for adoption rule of Canada and Vietnam.
