I am working on getting my spousal sponsorship application together.
My partner lives in Tanzania. He has two children from previous relationships. He is not involved with them - rarely is allowed to see them due to the other parent not allowing it.
I know I have to list them as his dependents on his application. But when they ask for the medical, what will happen if he can't get the medical due to the other parent not allowing it?
What do we do in this situation?

Second question, we have a son together. He was not able to be here for the birth so he is not on my son's birth certificate. I am assuming that I can't put him down as a dependent as there is no proof that he is his son. But I'm also guessing this wouldn't be a problem as our son is a Canadian citizen.

Any insight on these two things?

If he puts the children as unaccompaning they will have to go for medicals, and he will atleast have to show that he has tried to have them take the test. If the spouse has full custody and has papers that show the father is not given access to the children (Very rare for Tanzania) then he can attach this.

As for your child, on the checklist there’s a part that asks if you have children together, if he ticks yes then birth certificate is required. If he ticks no, then he will be misrepresenting. On Form 5406 additional family he has to list all his children, including the one in Canada. Add the father on the child’s birth certificate.

As for adding him on to the birth certificate for my son...I tried. He needs to sign the original paperwork and they denied his visitor visa to come for the birth. And the mail is not trustworthy sending stuff there.
 
If the children in Tanzania don't go through the medical, even as un accompanying, they can never be sponsored in future.

Note that the Canadian child will not be entered on the form for applicant and dependents, instructions are on the form. You would provide info on the separate form for info about all family members.

I have sent and received important mail from there with no problem at all. And takes around 7 days. Besides, at one point your spouse might have to send you document/forms he signed for the PR application via mail. You might want to look into all options to avoid complications with the application, and delays.

This is the exact same thing that is happening to me as we speak. We have our medical requests, but my husband is not provided with access to his children. We've hired an immigration lawyer in the Dominican Republic to see if they can help. We were also told the children need passports in order to get the medicals (IT MAKES NO SENSE!).

Praying that the children's mother softens her heart so they can at least get both the passport and the medicals done within the 30 days. This has been beyond frustrating since I've emailed IRCC with the same question you have. What happens if he cannot get access to the kids to complete the medicals? I sent a letter to my MP as well in hopes of a response. I've taken screenshots as evidence and I've had my mother-in-law right a letter as a witness to my husband having issues. These documents I sent in a webform to IRCC requesting next steps. Will keep you posted if I ever get an answer.
