Hi Samira,
No of course it will not cause any problems, as a PR he should be "residing" in Canada, a visit won't make him lose the "residing". ;)
I'm a PR myself and I stayed for 4 weeks. Cic doesn't exactly mention how many days short visits mean, but I think it's about a month. Cuz when I think about it, when someone is residing in Canada, he/she can't just leave the country for 2-3 months because usually he/she has a job or school or sth. So that's why I assumed 1 month is normal! That's all my assumption and based on what I read on other forums.
The part that I'm sure about is that a visit won't do any harm to an application. I remember asking the same question before leaving and Sohrab (who works for cic) assured me that my assumptions are right!
Very well said. My wife is a dentist and currently is studying for an exam being held in Feb 2013!! thats why she stayed with me for 7 weeks...lol I believe the problem is not aroused by CIC, u should first be able to convince ur employer ;)

I am not sure but i read that it is better for a PR not to stay more than 2 or 3 weeks out of Canada. Please correct me if i am wrong!
arezou jan thats not true, Canada Revenue Agency is in direct contact with CIC , as long as the taxes are done it shows the person resides in canada so it doesnt matter

Sohrab jan,

Then why all the lawyers encouraged my wife not to prolong her stay in Iran? Any idea?
BTW, neither she is working, nor she is a student....she is preparing herself for an exam.

I disagree that it's a good idea for a PR to stay "as long as he wants" with his foreign national spouse while the PR application is in process. For one, you have to keep in mind that a PR, unless he or she is working full-time for a Canadian business or the Canadian government, must meet his residency obligation of being physically present in Canada for 730 days (2 years) in every 5-year period to remain a permanent resident.

This way anyone can easily bypass the law of "residing" in Canada, right? U don't need to be physically present in Canada to do ur taxes....then whats all the emphasis for the PRs to stay in Canada while sponsoring their spouses....according to what u say there is no difference between a citizen and a pr. Correct me if I'm wrong.

Hello everybody

My wife who is waiting for her permanent residence is leaving Homs, Syria to go to Libya because her life is in danger. What's going to happen once she gets approved to get her permanent residence? Can she transfer her application to the canadian embassy in Libya so she can pick up her permanent residence there? How does it work?

You should have your wife go to the Canadian embassey in Damascus . we had a member, Ramz, who had a similar situation and her husband went to the embassey and talked to them, they asked him to go back in a few days and when he returned a few days later, they stamped his visa. the Canadian government has said they will process a visitor visa for a spouse of a Canadian living in Syria within 5 days. she should atleast apply for a visitor visa and finish the wait in Canada safetly.

I don't think there is a problem, I am a PR holder, I came from Canada to visit my husband, I've been with my husband 5 months and a half and my husband got his PPR while I'm visiting him and now we're coming back to Canada together :)

Thats great :D
Frankly, the feedback we got from different lawyers was a conservative approach. They all said that its much safer if the sponsor only pays a visit to his/her spouse and then returns to Canada. Personally, I prefer not to give any excuse to my visa officer while someone like u may take the risk. I'm happy that all went well with u and ur hubby, maybe we should have had this courage to risk too....at the end, risks and rewards come together!

I'm very happy for you that you're done with this process :)
And I think you got lucky that the visa officer didn't find out that you were out of Canada for almost half the process, that definitely is not "residing" in Canada. ;)
Best wishes for your life together in Canada :-*

there is a difference, the question i answered earlier was regarding a Citizen not a PR , that was my mistake, but a naturalized citizen of canada can remain out of canada however long he/she desires, even during a sponsorship as long as the intent to return to canada is acceptable by an immigration officer and according to the Immigration policies
