Conjugal Sponsorship Visa information need.

Hello,

I just dont know how desparate I want to apply to live with my partner, a Canadian citizenship. I moved to Canada in 2014 on student visa and lived with my partner till October 2017. In the year 2015 we applied for Common law sponsorship application, as hes Christian and I am Muslim, each one is happy with the religion therefore, he thought its the best to go with the common law application then getting married. We also asked the lawyer for advice unfortunately, the lawyer was not helpful and screwed us up by not informing wt exactly proofs we have to submit with the application. We were lacking proofs such as joint property's documents, driving liscence for myself etc we have only bank account together, and the beneficiery list that include my name. We have waited till 2017 to be approved but nothing happened, in 2017 jan, they asked for my medical which was done successfully, however, since i was married before in my home country divorced and have two kids, the CIC was in need of my children's medical as well, that i was unable to do due to lack of support from my family. I would also like to mention that at that time non of our family was supportive especially now his family is against me alot due to different culture, religion and my past. We have tried to give explanation through an affidavit from another lawyer. It was pretty tensed situation and we tried to contact cic via inquiry what to do in such case however, no response. I was away from my kids from 3 years and my family was pressuring me to visit pakistan as soon as posssible. Since i lost my status in such peeiod therefore, there will be no entry back to Canada. Then due to immense pressure i left for pakistan to do the medical for my kids along with their passports and guardianship certificate. However, CIC contacted us exactly after a year March 2018 asked for more proofs. Alas! The visa is refused as i applied inland application while i was outland and thus did not qualified the eligibility at the end.
I want to apply again as conjugal relationship as we cannot marry in pakistan as hes christian and in my country a muslim woman cannot marry a christian man and also now we have immigeration barrier as well as obviously CIC will not even provide me even visit visa just to go and my marry my partner.

Can anyone advice me or guide in such situation? How much possibly we can be accepted? Thanks

Do not apply conjugal. You are still considered common law even though you had to go back to Pakistan. You know what kinds of proofs they need, be sure to include them.

Thank you Buletruck and Alurra for the reply. Unfortunately we were unable to get the other supportive documents due to my expiry status. I-e utility bills etc.
Now we are taking the help of a consultant to see what are the possibilities? The things is we are not young anymore we are like middle age couple who are eagerly waiting to meet together once again. We have been in this adorable relationship from like 18 years and we still wondering what future is holding for us.

One question on my mind...why most of the comments goes against the conjugal sponsership application

Conjugal has to meet some very specific requirement that can be difficult to support or provide to prove conjugal status. Common law, despite having left Canada, is a better route. Not having bills or bank accounts in both names doesn’t make it impossible to apply common law. Other proof can be provided to support your application. Letters from friends or family, pictures, travel together all work for an application. It’s a much better solution, really.

Can you go to a third country (on holiday) and get married? That would be easier than trying to provide proof of common law that you don't have. Conjugal applications are very difficult to prove and unfortunately there is no barrier to the 2 of you being together to marry in a third country (i.e. travel to Europe somewhere and have a civil ceremony).

Good luck with whatever you decide to do.

Unfortunately no, .... but we are considering all the options in the mean time ... the problem yet is i have to take papers from my embassy for marrying outside the country. Ofcourse they will not allow. :(

Conjugal is for people who can't marry or become common-law. You are already common-law. It's like being 100% legally married and applying as conjugal. You don't qualify.
