I am a US citizen getting married to a Canadian next month. I am allowed to stay in Canada for 6 months with just my passport. We have a trip to Ireland planned for October. I have been here for about 3 weeks. So October isn't even near the 6 month mark. He will be applying to sponsor me once we are married and I will apply to be a PR. Is it wise for us to leave from here to visit Ireland? Or do I risk not being able to come back? Is it ok to travel while my application is being processed?

Hi there,

It´s always a thing traveling in and out of Canada while having applications in process :)

So... I understand you are in Canada, right ? So you´re pretty new here, and that´s an advantage, you´ve just been 3 weeks, so going in and out has to be completely ok. The thing is that if you apply for PR from within Canada, that is Inland, it has the advantage that yoiu can also apply for a Work Permit at the same time, but it´s expected that you remain in Canada during the process. If you apply Outland, you can still be in Canada, and you can travel, the only thing is you cannot apply for a Work Permit. But I read for people from the US applying Outland is pretty fast, and most people do that. so mayb in your case it´s more convenient. But in any case, since you have to wait for your marriage certificate to apply, and it takes about 2 months to arrive, you can travel to Ireland first, and then apply for PR, after your trip. And that is completely fine because you are just visiting Canada with your husband. But I syill think Outlnad is best in your case.

Hope it helps

My wife is from the USA and has only left Canada once since we applied. She had no issues coming back

Hi Helena,

If one applies Inland and also applies for OWP, can they travel once OWP is received and PR application is still in process?

A person can travel anytime regardless. The issue with an inland app is that if they are refused re-entry, the app is essentially considered abandoned. The risk of being refused entry is very low but always a possibility. The OWP doesn't change that.

Well yes, it´s supposed to be ok. Once you get your OWP, it´s considered a legal immigration document; a CBSA officer told me this in person, they require that you have a a legal document to let you in the country.

This considering that you´ve been for quite some time in Canada, if you are new and never left, going out for the first time should be ok. But having a OWP is a strong thing. You have to know though that there is always a risk, and also they could ask you if you are working. When they give you a Work Permit, it´s because they expect you to work, they want to see how well you get adapted in Canada in general and in the working market.

The OWP is not that kind of document. Yes - it keeps your status legal while you are in Canada. But it does not authorize re-entry. As explained by canuck_in_uk, there's always some risk of being refused entry - an OWP doesn't take that risk away.

Of course it doesný authorize re.entry, I actually said that still there is always a risk, even with a OWP, but it is definetely not the same leaving Canada without any paper while PR is in process than having your OWP.

Huge difference.

No, not any different. An inland applicant with an OWP has pretty much the same chances of re-entry as an outland applicant who was in Canada as a visitor.

They are 2 different situations.

But in any case, I think statements coming from officials themselves are pretty accurate.

It all depends on how important is the trip to the person and if it´s worth go through a bit of risk.

There are no statements from officials on here.

You're funny :)
I was told so by a CBSA officer.

But in any case, it´s a personal decision from the person who asked the question.

Either way, a US applicant should almost never go inland, and for all applicants, if the need to travel is so great, they should go outland

I'm factual. You stating that your information comes from a CBSA officer doesn't make it a statement from an official; it is still just something you said.

Yes, it is a personal choice whether to risk it or not.
