Guys

I have a very complex situation.

I have a closed work permit that ends in May 2024 and my employer will not extend it.I did not work 12 months.I live with my boyfriend as common-law partner since October 2022.
My bf is willing to sponsor me but the whole process might take around a year.
We are also planning a baby together.What will be the best approach to stay in Canada till the sponsorship process is done.

Any help will be appreciated.

You’ve pretty much already qualified to be common law, just make sure you guys have things to prove you actually are in a common law relationship.

Based on your username, I'm assung you're Viet.

You can apply for spouse/common-law sponsorship.
- If your wp expires in May 2024, apply for PR now since it may take 1-2 months to get AOR
- Once you get AOR, you can apply for your open work permit.
- As long as you file your OWP before CWP expires, you're fine.

Your situation is not complicated at all. Rest assure.

My official status is still married.
Its a mutual separation and everything should be completed in 3 months.
Should i wait for divorce to ask my bf to apply sponsorship.
My CWP end in Oct 2024 whereas my visa end in May.
Thanks so much for your guidance.

How long have you and your boyfriend been residing together?

You can wait until the divorce is finalized.

If your cwp expires in May, you can apply for visitor record in March. As long as you file it before the expiry dates then you should be good.

My CWP expires in October however my visa expires in May.
the visa is only required when you need to enter Canada. Immigration documents (WP, SP, VR) are to determine your status. Your visa expires doesn't mean you are out-of-status. You are lack-of-status only if your documents are expired and you haven't file extension or change of your status before it.
