An advice to all new applicants. By law physical presence is not required to fulfill the requirement of Section 131 (b) of IRPA. Which requires sponsor to be resident of Canada incase he is not a Citizen yet.
BUT they don't give a F about law up there in CIC coz no one is there to question them. Even in my Case IAD clearly said The VO decision is invalid at LAW but our time precious time has been wasted.
Even after being refused and filing an appeal I visited my wife twice for periods of a month once and two months second time. BUT as per my own experience i would advise all not to visit more than two months at a time. Instead make shorter but frequent visits like 3-6 weeks every 4-5 months.
In these three years of our sponsorship I didn't let CIC totally control our lives as if we are there slaves. I still being a PR visited my wife every 4-5 months despite being refused once for staying 6 months in a row.
It is my advise to all don't over stay but in the meantime it doesn't mean you guys are CIC slaves and can't visit your spouses because your are not citizens. Stay cautious but at same time have faith in Allah and never let CIC ruin your married lives. Do regularly visit yr partners if yu can afford. Even religiously it is yr first priority to frequently visit yr Spouses.
