I'm going to Islamabad tomorrow and lets see what kind of trouble I can get into as my health is failing and this needs to be done now In Sha Allah with the help of Allah in all things.

I spoke to my children who are all young adults along with my grandchildren and they all want us home ASAP In Sha Allah.

I said oh please pray for Nan and *****. They were all happy to do so!! May Allah hear all our prays In Sha Allah

Salam to all who are waiting for a long time. Necessity is the mother of invention. There unspecifed time lime has created a invention. Any one can discuss with there lawyer or consultant about this new thing and I am hopeful reply will be positive.
We cant bring and live our spouses here because govt say the procedures and polices. Ok we accept that. But if as a canadain citizen or as resident of canada want to live back home with the spouse for unspecified time untiill spouse get the visa. it may be to 2 year or 3 year. Pakistani spouse might be dont have a right (as per govt policies) but as canadian resident we have a right to live any where in the world specially with the spouse. But Law say if we live more than 06 month out of the country we lose our residency. Court can give us the relief to live out of the country because we are not asking to speed up the case. we want to stay back home with our family. once the people will start that practise. govt has to think some thing differently.
THe basic point on which couut can give us the relief, unspecified time frame by the govt like we are in the blind alley. is ko kehty hey. jis ki bili usi ko meaon.
when the two govt laws contradict each other One has to to be invalid. we cant go there for unlimited time to live with our spouse. and the govt is making us smart by giving us unlimited processing time. but they dont know this can be reversed to them.

Forget to tell one thing more . Now under the current polices if some one live with there spouses in back home. Foregin embassy reject the cases becuse old laws says( when the time frame was 06 months) Sponser has to live in canada. untill the case processed. At that time immigratin departmemt issue every one a acknowledgement letter in which no of months was mentioned that case will be processed in such and such months. Immigraiton department doesnot know how much time it will take to process our case. but we can live out side if court give us the relief. now pakistan is 29 months. so as a sponser I can live 29 months in back home with my spouse. It will save back and forth travelling cost. Enjoy the backhome without losing resident staus. that is the best thing. it is very good option for some people. who dont have much family here. it will also save two time expenses one is here another is there.

Most people who are going through this are doing so because they have families here that they have to support, they dont have an alternate. If you do not have to support your family here I do not see any reason why would someone want to stay away from their spouse.

I already have this point in my mind. if some one get relief in 1st step. On the basis of that relief. The same person can go again to court for some financial support. he can claim that court has given him a relief to live with his/her family for indefinte period. He can say that he is the only person supporting his family and he has to leave his job unwantedly. If court can give hii/her some financial support like EI 50 or 60 cent of his pay. then it will be easy for him/her to live with ther family. and it is your right . Because we are not quiting our job vouluntery. We dont have any option and it is our human right to live with our family as we dont have any kind of immigration issue or immrtaion policies. Now this is not an immigartion issue. this is federal legel issue or human right issue. and I think because there is not any kind of securites issues involved in this legel matter. Court will give relief. Court only dont give relief. when there is security thread through immigration etc. We want to stay back home with our family. Jason cant say its a security thread. Even if court give me relief. I dont mind they can take 10 years to process my case. I will not lose my residendy and if govt give me some financial aid. I would like to stay there with my family until the case approved. When people will start this practice. Immirtaion departrment will revise there policies. when there is a will there is a way.

My answer will be immigration is a privilege not a right, you knew about the process before you got married. If you didnt have the money to run 2 homes than you shouldn't have started the 2nd one to start with. You knew about the limitation during your PR status as well[3 years within 5 year period] so why dont you stop whining, man up and sit through what you opted for.
