It's not sad - it's irresponsible on the part of the applicant. The applicant is responsible for all of the information in the application regardless who completes it.

agreed that it's the applicant's responsibility to ensure that all questions are answered correctly, but it looks to me like that one question (past refusals) is where most applicants end up making mistakes and getting 5 year bans. why do they bother asking the applicant if the visa officer is able to dig up that information themselves? is it a relic from back when everything was paper based?

Either you read this question yourself and answer honestly or you check all the forms and correct mistakes and only THEN you sign. OR you lie, or your adviser lies and you let him to.

Not sure why you think it's "most". It's not. If it was "most" the volume of refusals would be insane. The vast majority of applicants have no issues answering this question correctly. A very very small minority either lies or doesn't read the question properly. There's no problem with the application - the problem is with the people who complete the application. It's a very simple question. Not sure why you're so fixed by this.

Besides, if you have doubts answering such a kind of question- there is a place (a box) where you could explain your way of thinking (in any case if you ticked there "yes" or "no")

Hi,

Applicants must be honest. Honesty is non-negotiable for visa apps.

5-years ban for misrepresentation are given only after due scrutiny and investigations are done. Also, an applicant is given 30 days to prove that the visa officer is wrong.... before a decision/ban is given.

It could be genuine oversight/misunderstanding a question in the case of some applicants.


You'll be fine if you check/re-check your wife's TRV application to ensure there are no factual errors or typos.... before you sign/submit it

My parents applied for visa
Mom was rejected 2 years back.
Agent filled it and said sorry now. They receive that you have given wrong information. Now agent is saying you should re apply asap to prove them that you are innocent instead of giving a gap and applying next year.

I am confused. Any suggestions.

Agent filled it and said sorry now. They receive that you have given wrong information. Now agent is saying you should re apply asap to prove them that you are innocent instead of giving a gap and applying next year.

Was your mother given a misrepresentation ban or just refused?

Applying immediately again doesn't prove anything. I'm not sure what you mean by innocent. The question was answered incorrectly on the application - and the application was therefore correctly refused.

It was only refused and it says you can re apply.

Paper applications dont have agent name so he said sorry now and said i can give steong civering letter and you should apply now
Some say not to apply so soon. Some say apply.

Mom 2 rejectuon
Dad - 1 rejection

Innocent means to prove them

I have 9 year old sister. We didnt apply for her. She wll stay eith grandparents.

It is mentioned in letter under my dad name that yourspouse has failed to declare the previous visa refusal as req by canadian law therefore i am not satisfied that you would respect the terms of conditions.

You are welcome to reapply if you feel you cab respond to these concerns and can demonstrate .......

There was no letter along Mom passport . Only 1 with dad passport

Why IRCC still refuse VISA with misrepresentation after answering the procedural fairness letter truthfully and honestly
The PFL letter is your chance to correct IRCC if they think you misrepresented something in your application - but you didn't and IRCC made an error.

If you did in fact misrepresent something in your application, then IRCC is within their right to refuse your application and ban you for misrepresentation.

It is very important to fill out the application accurately and answer all questions truthfully. You don't get a second chance in most cases.
