I have now completed the assessment of your application for a permanent resident visa as a member of the Canadian Experience Class and have determined that you do not meet the requirements for immigration to Canada.

According to the Immigration and Refugee Protection Regulations, applicants in the Canadian Experience Class are assessed on the basis of the pass/fail requirements set out in subsection R87.1(2). The assessment of these criteria determines whether a worker with Canadian experience will be able to become economically established in Canada. The criteria are:

· knowledge of English or French,

· Canadian skilled work experience,

· Canadian educational credentials (for the Post-Graduation Stream only).

Your application was assessed based on the occupation which you identified as part of your skilled work experience in Canada: NOC 6211 sales supervisor/technical sales executive

I am not satisfied that you meet the skilled work experience requirement based on the information provided. You requested assessment under NOC XXXX for employment with XXXX. On Schedule 8 of your application you listed employment from 24/05/09 to 30/11/12. However your Schedule A form and your employment documents indicated employment from 24/05/09 to 30/11/11 only. Your application was submitted on 08/11/12. Work experience obtained outside of an applicant’s qualifying period (08/11/09 to 08/11/12) cannot be considered eligible employment under the Canadian Experience Class. In support of your experience you provided letters dated 28/8/12 and 31/5/13 from XXXX confirming your employment from 24/05/09 to 30/11/11. This letter stated that you earned $22/hr. You provided a T4 statement for 2011 and Notice of Assessments for 2009, 2010 and 2011 which listed the income you earned. Your earnings do not indicate you have acquired the equivalent of 24 months (3900 hours) of full time equivalent work experience during your qualifying period. Consequently, you have failed to demonstrate that you have acquired twenty-four months of full-time skilled work experience in Canada at a National Occupational Classification skill of type O or level A or B in the last thirty-six months prior to the submission of your application.



Subsection 11(1) of the Act states that a foreign national must, before entering Canada, apply to an officer for a visa or for any other document required by the Regulations. The visa or document shall be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act. Subsection 2(1) specifies that unless otherwise indicated, references in the Act to “this Act” include regulations made under it.

Following an examination of your application, I am not satisfied that you meet the requirements of the Act and Regulations for the reasons explained above. I am therefore refusing your application.

I didnt understand the rejection reason. Isnt capricon has 3 year work experience ?

Now I am afraid for myself..I graduated in May 2011 and started working from july 2011 on offcampus workpermit as my PGWP came after a month. I worked till oct 2012 between in between I change company where i waited for 2 weeks before joining new company.

his employment documents only proved that he worked for 1.5 years, and since he applied in November of 2012, at that time CEC rules said he had to have at least 2 years of work experience

Don't let your hands down Capricorn.. Resubmit and this time you will succeed.

You will definitely succeed if you try again with the new rules.

I think VO made a mistake bcoz I worked from may 09 to nov 2011
I have no Idea why would they refuse me

My employment letter showed that I am a full time employee working 37.5 hours
