Hi Harry,

As your application was withdrawn and the fees was refunded to you, the answer is NO. Because if the Visa / Work Permit is refused CIC sends you a Letter in pdf stating the application number and a possible reason for refusal and they never refund the fees. Refund is only given when the application was not processed. In this case you can answer NO to this question.

Also ensure when you apply , try to apply online for TRV if you're comfortable instead of a paper application. You'll be able to track the application. Moreover get all stamped and visa pages of your passport in one pdf . If your pdf is too large as CIC allows a certain size use this tool : www.pdfcompress.com to compress, it will keep the contents as is.
You can also use this online tool to merge and split pdf's : http://www.pdfmerge.com/ & http://www.splitpdf.com/ All these tools are free. Good Luck !!!

Hi There, Though on CIC website this one sounds confusing, however you are eligible to apply for BOWP once you have the AOR.

Look for: CEC: the “Eligibility CEC” decision has been set to “Passed” OR the Acknowledgement of Receipt letter/e-mail has been sent from CIO.
So it has the word 'OR' so even if your eligibility in GCMS is not set to passed , if you have AOR you can apply. I applied for mine last month , I dont have the eligibility in GCMS set and I've applied through a very famous Law Firm : Green & Speigel . They confirmed that all I need is AOR.

Moreover I asked CIC agent in my conversation yesterday and the agent confirmed that AOR is sufficient. Call CIC if you still need to confirm. They will tell you what I just said.

Where was it mentioned? When did you apply for BOWP? I have applied on July and received on November with my PR still "In Progress".

Sorry for the above description , I just checked and found that the link I mentioned above was posted in 2012. The one you sent is the recent one.

Now the real question is if this applies to applicants who will submit BOWP after Dec 1 or to everyone as it says anyone who has submitted APR before JAN 1 2015 and not under Express Entry. I am asking my Lawyer and will update whatever answer we get.

Please if anyone can call CIC, do confirm. I will call tomorrow if noone calls.

They delayed eligibility assessment , but they ask for it mandatory , it is ridiculous, why not just post a tag on CIC website, Please get out of Canada , Old CEC is not welcome at all .

The major barrier is... In addition to the AOR, we have to pass the Eligibility as well which has not even started yet.

Case:
So if your BOWP is expiring next month and you did not pass eligibility but still hold a full time job and AOR, according to the new rules, they don't freaking care about your and just refuse your BOWP because of your Eligibilty still not passed.

Then you should quit your job right away and start appplying for restoration and what ever freaking court thing that you are talking about.

So I advise you just do not comment and suggest us not to bother about this just because you can file a petition in court. because you still loosing your on hand job temporarily or permanently who know?

I think you better understand what the concerns are here and comment accordingly going forward.

Alright Guys,

I finally called CIC again and asked for the BOWP eligibility as per the new rules, they say the same as on the website that it is a qualifying parameter and if its not met then you are not qualified for BOWP.

Im just stating the conversation I had , please call CIC to confirm if anyone wants to.

Also the agent insisted that I should not be worried as I applied my BOWP in Nov 2015 so by the time they process my BOWP my eligibility will be set to Passed.

However thats not of any help for those whose BOWP applications are being processed right now.

How do we know if an applicant passed eligibility? When I filed for CEC there was a year + on my work permit, That should be enough to have the eligibility completed, however they paused processing CEC applications for more than a 8 months

I understand my friend, the only way to find out if as of today the eligibility is passed or not is by calling CIC with your UCI #.
It does not make sense for CIC to first delay the eligibility check and then make it a qualifier for a BOWP.
However, talk to the lawyers / immigration consultants if possible.
