Hello, please help.

I am Canadian, who currently works in US under TN-visa.
I plan to marry a Vietnamese person in Vietnam, then sponsor her to Canada. Since I am a Canadian, but not a resident to Canada, is the sponsorship possible?

If not, can I establish myself such that I am also a partial residence in Canada (i.e. own bank account, travel home every 6months) and still work in US, then can sponsorship be possible ?

Please suggest how can i make this possible ?

Thanks.

You can do it if you convince immigration that you both will be coming to live in Canada when your wife gets PR. Proof of that could be job offer, acceptance to college, arranging housing, letters of relatives supporting your plans, helping you with housing etc. etc.

Is this mean, I must work in Canada after successfully sponsor her to Canada (does she get PR right away ?)

Suppose, if we decide to get marry and live in Vietnam for couple of years (provided that I got an professional job offer to work oversea)...am i allow to live and work in Vietnam after I married to a Vietnamese person.

Thanks you.

She gets PR as soon as she "lands" in Canada but nobody will force either of you to stay and live in Canada. However, if you don't, you are making it just a little bit harder for people who come after you. They allow you to sponsor from abroad because you are planning to come and live in Canada but if a lot of people abuse this when they are actually not intending to live in Canada, they might make it harder in the future or even cut it off that you can sponsor from abroad. Of course that will not affect you since you will already be done but it will affect other people.

I can not tell you what the immigration law in Vietnam is like for spouses of Vietnamese citizens. Asking that here would be like going to a Vietnamese immigration board to ask about how you sponsor your wife to go to Canada ;)

Thanks youLeon.

Would my sponsorship of her be harder (as to convince Canadian government) if I get GreenCard ? I am thinking that GreenCard implying that I intend to work and live outside of Canada, currently I only on TN-visa.

Thanks,

green card in the US or in Canada? You are Canadian citizen, right?

After she lands in Canada and becomes permanent resident of Canada. Your wife has the right to move anywhere you want. Even if she moves out of Canada, it won't affect other people application (as in my opinion). It is absolutely up to you and your wife to decide where to live or where to go after she has her PR in Canada. It just takes longer for her to get citizenship status

If you can not prove that you will be working and living in Canada then your application will be refused.
US green card does not play any role in applying for a PR status in Canada.

In my opinion, if immigration didn't care where they live after immigrating, they wouldn't make them prove that they are intending to live in Canada. Of course it's their right to live whereever they want but if it's the intention of CIC that they allow this to make it easier for people who are moving to Canada with a foreign spouse and they find that people are using this when they are in fact not planning on moving to Canada, they will at some point reconsider if to allow this at all.

His wife will not be able to apply for citizenship unless she lives in Canada at some point for 3 years in a 4 year period. She will however not lose her PR because of residency requirements as long as she is living with him.

Thanks you nguyentu2001 and Leon.

So this mean, I am allowed to marry her in Vietnam, while living and working in US (I am a Canadian on TN-Visa).
I must find a new job in Canada and move back to Canada, should I start to sponsor her out of VN and into Canada.

Would I complicated my case if after our marriage, I decide to live and able to find work (in professional jobs) in Vietnam ?
I intend to work in Vietnam for couples of years until she finish her MBA; after that, I would start to find myself job in Canada and sponsor her.

Thanks you for your help....

You don't need to live in Canada to sponsor her for Canada PR. You have to convince immigration that you are planning to move to Canada when she gets PR.

If you are not planning on moving to Canada right now, you can also wait with the sponsorship until you do.
