Can the sponsorship application once withdrwan be processed again or can you reapply immediately?

I am married to a Canadian citizen I lives in UK, we have been married for less then a year, my wife came to UK on my dependent via (Spouse) and stayed with me for four months after that she went back to canada. But after going back she starting to change her mind and she withdraw the sponsorship application without thinking or discussing. After withdrawing she realized she did wrong and it was her stupid act in anger, and now she we are getting back together.

i would like to know once withdrawn can she processe the same application with the help of the lawyer or do anything?? If not can she apply for a fresh sponsorship application straight away again or do you have to wait for 5 years. (No decision was made application was under process)

my wife speak with the same lawyer who withdraw the application and she says she will see what can she do. i am guessing there isnt much lawyer can do they are just trying to get money out of your pocket and at the end they will say oh sorry you need to make a fresh application again.

can anyone please guide us what to do in this situation and how to resolve it.

I'd say your 2nd bolded paragraph is right on track . . . just re-apply immediately.

Did CIC send your whole application package back?

I think you can simply re-apply again. If they didn't send you anything back though you'll need to get new police certificates, new proof of medical, translations, all your proofs etc etc... all over again.

My wife speak with lawyer today and she said the same thing as i wrote that once withdrawn you can not do anything.

she also said that you can not re apply for a certain amount of time like 6 months. which doesnt make sense to me as per the CIC rules once a decision is made you can not withdraw the application but if you withdraw the application before decision and visa issuance the withdrawl is like you never submitted the application and logically you should able to make a fresh application straight away with new documents.

CIC didnt send any documents back yet as its only been two weeks since withdrawl. Can you use returned document again e.g. police certificates, medical, etc???


am i correct or you have to wait 6 months before she can make a fresh application??

If they send the certificates back you can use them again as long as they are still valid (meaning they were done within three months of when they will be received by CIC). I am not sure on the waiting thing, I have never heard that you would have to wait. I have read over CIC's rules on reissuing the package and have never seen anything about having to wait.

I've never heard of waiting 6 months to re-apply. Lawyers are not always right. I would ask your lawyer, what specific clause or indication from CIC regulations requires you to wait 6 months?

Not sure if they will return your application package though. Knowing how CIC operates I wouldn't be surprised if it just disappears... but hopefully they do send the whole thing back you.

Hi Thanks for all your support and advices. The problem has just taken a new turn and i need some guidence about this.

i am going to make it short, my wife under depression and medication made the decision to withdraw and lawyer advised her to withdraw stating my intention were to enter in Canada through marriage. Now she regrets and cry over it but there is no point now. is there anyway we can fix this???

She says she will speak to the MP and will come to Canadian High Commission, London explaining them the situation and circumstances she made a mistake etc. will it work or there is any other way??

Considering this if we re apply making a fresh application how this will be taken into account seeing the previous application was withdrawl stating intention to enter Canada through marriage.??


We are very upset depressed but there is no point crying over spilt milk please help.
