Can PR application be rejected under the applicant's infidelity in Canada?

The wife of my brother is now in process of permanent residency in Canada. She entered Canada as happily married with kids whom she'd left in the Philippines.However, during her stay in Canada as a contract worker, she had an affairs with several men and now currently living with a Canadian guy. My brother has now already moved-on with what happened to him and currently have a common-law-partner in the Philippines. His wife (not yet annulled in the Philippines) wants to include their kids on her application for PR but my brother strongly refusing the intention. Can my brother do reporting to the immigration about the infidelity of his ex-wife so she could not be able to obtain a permanent residence status as he really wanted to get an annulment first with her and settle the custody of their children. If yes, how to report that to Canadian immigration?

Irrelevant to the PR application...
However, she does need either his consent or full legal custody of the kids to bring them to Canada. Without his consent on the application, the kids won't be included. Also, she can obtain a divorce in Canada, so the annulment (in relation to the PR application) is irrelevant also.

Thanks Buletruck, can she obtain divorce in Canada without the appearance of my brother or signing any documents from the court? I heard that some caregivers here were able to get PR status and faking the signatures of the husbands back home or by asking a third party to sign the divorce paper then show it to the immigration proving that they already got consent from the husband to divorce.

She doesn't need his signature or a divorce or an annulment to get her own PR status. Her "Canadian Guy" could apply for her as his common law spouse, even if she's still married. Your brother can't do anything to prevent her getting her permanent residence. It's a waste of time to even try.

I don't get the part about infidelity.

Agreed. The child custody or their immigration is a different matter. The ex husband will need to sign off or she needs full legal custody. But as far as her PR application is concerned, the ex has no say.

I met a lady before who got a certificate of divorce here in Canada, eventhough she is married in the Philippines. She mentioned it takes a lot of money and time to do that process.
She can apply for PR but if she wants her kids to be included in her application, she needs the consent of the husband. Inless she wants to settle the leaglilties of this first.

No. Not at all. Her husband is uncooperative. Thats why im also wondering how can she get a certifcate of divorce here in Canada. She did hire a lawyer though.

My brother is firmed with his decision not to send their children in Canada however the wife keeps on pushing him now to send their children for medical tests in the Philippines. He's asking for annulment but the wife doesn't like to go back home and spend money from her own pocket. She wants my brother to shoulder all of possible expenses which probably cost them more or less PHP 280,000 or CAD 6,900. So our family is trying to come-up with a solution to resolve the issue by reporting this matter to the immigration and hopefully they will look after the real marital status of that woman and what she did in Canada ( a certified homewrecker) before granting PR status. If that's the case, she doesn't have an option but to file an annulment first and cooperate with my brother.

Easy for her to get a divorce same as others and I'm fully aware with that norms. Anyway, thanks for the inputs..
