Hello guys,
It's a general question that I have seen in many Canadian visa forums that:
Can a married couple who comes to Canada on a visit visa settle there by doing some sort of family planning for example having kids in Canada? after having kids will they eligible to apply for a stay or PR in Canada?
Thanks.
You've probably seen the same answer on all of those visa forums. The answer is NO.
Their baby will be Canadian but this will not give the parents any rights. They will have to qualify for a visa or apply for PR on their own if they want it. If they are not successful, they can take their Canadian baby back home with them.
The child will grow up and may move to Canada on his own when he reaches the age of majority. He may at that point also sponsor the parents but only if he is making enough money to support himself and his parents and any other minor children they may have and he needs to make that kind of money for the past 3 years in a row before he applies. As an 18 year old without education and work experience, it's unlikely that he could make that kind of money so the parents would first need to fund his education to get him a well paying job and then he needs to work for 3 years before he can sponsor them. As a young person, maybe he will find love and want to start a family of his own in which case, he must show enough income to support his own family as well.
