Hi,

We've APPLIED FOR PR IN FEB2010. CURRENT STATUS IS IN PROCESS.
We got MR, Employment letter request,PCC in Jan 2012 and we sent the MR,PCC and updated employment details in Mar 2012.

Now we have received email, asking for
Updated IMM0008 “Generic Application Form For Canada
Updated IMM5669 “Schedule A” for yourself and your spouse
Updated evidence of settlement funds (showing 6 months deposits/ withdrawals history) for yourself/ your spouse
Original police certificate for yourself and your spouse from the State where you are currently residing
Updated letter of current occupation (employment/studies) for yourself

1) What is the meaning of this? is this positive news?
2) Also, we have a baby now 3 months old. So what all documents we need to send for the baby along with these docs ?
3) And last time, it took long time for FBI report where as in the email its mentioned we need to send docs within 60 days of email. So what should we do ?

Thanks for your help in advance.

Hello Canada_pr1,

I am too Feb 2010 applicant and in same mess. I added my spouse during application "in process" and still waiting for PPR. I have recently submitted FBI report for my spouse but now, our medicals are expiring soon. Perhaps CIC is waiting for its expiration to proceed further :( (to create more mess)

Regarding your case, you should submit the requested documents to CIC. FBI these days won't take that long. You will get it within 4-5 weeks. But, you should declare your new born and submit all the forms on his/her behalf too. If you inform CIC of the new born, they will advise you the required form for the baby. Declare the new born asap. As far as I know you should inform your changes in family composition to CIC, it's mandatory. Otherwise later you may end up with problems. I hope this helps. I believe seniors with similar experience can add more.
Thanks

CyTric

This is shocking considering you already have Medicals done. But it appears from your post that you are asking questions and answering them at the same time by yourself. And that suggests to me that you already knew your IELTS wasn't that great, and a couple of other missing link? What was your initial total qualifying points? It appears you were probably on the borderline? What's your NOC?

I feel so sad to hear this news, but were you holding a valid work permit or it got expired?

Hey Ram, I know how it must be going for you. May God Bless you! Did you get medical request ever or did you do it on your own? 'Coz to best of my knowledge Buffalo & Ottawa request medical only when then are done with points checking?

Ok I see you got one from Buffalo on Oct 2011. In that case, I would suggest to re-appeal with better IELTS ASAP. Filing in court may be an expensive proposition with unknown results as it pertains to point calculation.

My medical will expire in march 2014. They extend my medical from march 2013 to march 2014.

Thanks

Thanks Gary,

You knew in advance that your medicals will be extended or you came to know only after receiving your passport, after seeing entry date on the visa.

My medicals will expire on 14th April so I am not sure if they are going to extend my medicals and give me more time to move to Canada or they will ask me to go there before 14th April,Which will be little too much.

dear I got 25 points in eduction , immigration deducted my arrange employment ponts (15) so now my total point is 64 so plz give some suggestion what shoul I do now even my arrange employment is true , my employer is guiding to go in federal court , but it's very expensive so plz give suggestion guys

I think rule changed to LMO from AEO but since yours is old case, you can try. I suspect there is some issue with the employment, some employers are not eligible to hire due to higher level of scrutiny. Try your luck though, else, use WP option and then apply for CEC within Canada when duly qualified.

Ram, I suggest putting your question also in Background check thread of Qorax. He is most knowledgeable and helpful person I've seen in the forum.

Post a breakdown of your points awarded for every category, lets see how we can help? Also did you get medical request from CIC or you did it yourself in advance?

i got this response

I have now completed the assessment of your application for a permanent resident visa as a skilled worker and have determined that you do not meet the requirements for immigration to Canada.

Subsection 12(2) of the Immigration and Refugee Protection Act states that a foreign national may be selected as a member of the economic class on the basis of their ability to become economically established in Canada. Subsection 75(1) of the Regulations prescribes the Federal Skilled Worker class as a class of persons who are skilled workers and who may become permanent residents on the basis of their ability to become economically established in Canada.

Pursuant to the Immigration and Refugee Protection Regulations, 2002, skilled worker applicants are assessed on the basis of the requirements set out in subsection 75(2) and the criteria set out in subsection 76(1). The assessment of these requirements determines whether a skilled worker will be able to become economically established in Canada. The criteria are age, education, knowledge of Canada’s official languages, experience, arranged employment and adaptability.

Your application was assessed based on the occupation(s) in which you requested assessment: Executive (Marketing)-0611 and Bookeeper-1231. The table below sets out the points assessed for each of the selection criteria:

You have obtained insufficient points to qualify for immigration to Canada, the minimum requirement being 67 points. I have not awarded points for Arranged Employment as you do not have a valid Arranged Employment Opinion for an active company.

You have not obtained sufficient points to satisfy me that you will be able to become economically established in Canada.

Subsection 76(3) of the Regulations permit an officer to substitute their evaluation of the likelihood to become economically established in Canada if the number of points awarded is not a sufficient indicator of whether the skilled worker may become economically established in Canada.

I have reviewed your application and the information put forward and I am satisfied that the points that you have been awarded are an accurate reflection of your ability to become economically established in Canada.

Subsection 11(1) of the Act states that a foreign national must, before entering Canada, apply to an officer for a visa or for any other document required by the regulations. The visa or document may be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act. Subsection 2(2) specifies that unless otherwise indicated, references in the Act to “this Act” include regulations made under it.

Following an examination of your application, I am not satisfied that you meet the requirements of the Act and the Regulations for the reasons explained above. I am therefore refusing your application.

The Right of Permanent Residence Fee that you have paid is refundable. You will receive a cheque from Citizenship and Immigration Canada within several weeks.

Thank you for the interest you have shown in Canada.

Yours sincerely,

Hi Ram84,

They have clearly mentioned that "you do not have a valid Arranged Employment Opinion for an active company", what does this mean? Is your company no longer active? you must be having work permit under them or you dont?

Hi ram84,

this is definitely not a good response, have you work permit was expired or you're not doing any job with the stated company?

Wish you very good luck for your future endeavours.
