guys plz give me value able suggestion plz anyone

few days ago ottawa asked me updated employment latter , i got HRDC approval in nov 2009 till dec 2013
and inOCT 2012 my employer merge his company with another company
actually my employer got 4 company under his name before oct 2012 and in 2012 he merge his all companies in one company
and he issued my new employement latter under new company and Copy of Certificate of Amalgamation issued October 1 2012 by the Registrar of Companies in BC confirming the aforesaid amalgamation; rest all other urgent document needed for arrange employment
so i send all those document to ottawa explaining everything ,
my employer is saying that it was his plan from last 9 month to merge his companies , so he can not stop his decision only for , so he is right on his point of view ,
but my employer issued my new employemt latter and provided all documents , this company is running from last 5 year in B.C morethan 35 employees
still immigration officer rejcted my arrange employemt


guys plz suggest what action i can take from here , do i have to go federl court or any other suggestion
i was from last 39 months , and in may 2012 buffalo did all kind of inquiry with my employer and that time they were satisfied
suddenly i dont what been wrong with them , i got medical request from buffalo in oct 2011 and landing fees request
i am really upset guys i donot how to react on that :( :'( :'( :'( :'( :'( :'( :'( :'( :'( :'( :'(

What about your status in canada then? In the requirements, they have clearly mentioned that your status must be valid at the time of issuance of PR

guys i am in india right now , i finished my study in canada than i came back home ,
i did my medical in canada , i thought my ppr was coming soon , i took decision to go back to india , wait for ppr their
i was proved bigest mistake of my life ,

guys but employer is still with me , he is willing to help me at any point
do you think i have call HRDC explain everything ask for new arrange employemt under new company name
than my immigration officer can consider my case again ,
i am engaed here in india , she did masters in india , if i ll do marriage , i can add points of my suppose leter on i can get 5 points for that
that my ponits will become 69 , is their any way plz suggest

Dear, you took very wrong decision to go back home and because your work permit or study permit was not valid at this very point, thats why they cant issue you PR. You have to have valid satus in canada no matter you work or not, that is differnt story. Now, what you can do is to consult good lawyer and appeal for your case. I am not sure but it would be entirely based on the discretion of that person who gonna handle your appeal...now the system of point calculation under FSW category has changed and may be you be require to apply again with new criteria. I hope everything will be fine with you and ll pray for your bright future dude.

Hey ram84,

we can understand your frustration, but if you consider again to re-apply you need LMO for arrange employment offer as for now, AEO is no longer consider and CIC changed it's rules, new LMO will be needed for it, I hope you'll get the passing mark after adding your spouse but you need to re-apply with a fresh application at this point IMHO.
Now you're unable to fall under FSW-3, you have to apply as FSW-1-2.

Category 1 (FSW 1): For persons in an occupation which corresponds to the list of occupations identified in the Ministerial Instructions and have evidence of one year of continuous full-time (or full-time equivalent) experience in that occupation;

Category 2 (FSW 2): For persons who have arranged employment offer with a Canadian employer; or

Category 3 (FSW 3): For students or workers who are legally residing in Canada, and have done so for at least 12 months immediately before submitting their application.

Try improving your documents and then consider applying, don't rush and waste your money and time.

I also do think that apart from your status in Canada, which is a major factor that worked against you, the visa officer may have been concerned about your IELTS score. If I were you, I wouldn't have applied with that score in the first place (even when you think you can get points from somewhere else).

I also think that your application was judged based on documents you submitted, and so, you should start looking forward to real options/next steps, instead of thinking you can magically give them a new IELTS ( for an old application) or other documents which ultimately should have been presented before now.

Take sometime to think logically, put yourself together, and prepare a strong/new application (if you are still interested in Canada). I really don't think it's worth it flogging a dead horse, and besides the reasons for refusal are quite obvious - so I don't know if appeals and/or litigation will help.
 
Hello all,

I was asked to submit the following:

· Updated evidence of settlement funds (showing 6 months deposits/ withdrawals history) for yourself/ your spouse
· Updated letter of current occupation (employment/studies) for yourself

So my question is what do they mean by Updated letter of current occupation (employment/studies) for yourself. Is that a personnel letter or official letter? Is there any kind of forms for that? Please advise.

Regarding your case, you should submit the requested documents to CIC. FBI these days won't take that long. You will get it within 4-5 weeks. But, you should declare your new born and submit all the forms on his/her behalf too. If you inform CIC of the new born, they will advise you the required form for the baby. Declare the new born asap. As far as I know you should inform your changes in family composition to CIC, it's mandatory. Otherwise later you may end up with problems. I hope this helps. I believe seniors with similar experience can add more.

Thanks Cytric for your response. My medicals are probably expired.. but somehow they have not asked it again. Few days before I sent mail to CIC reg this, that I was requested to send medicals and I sent it out immediately and after that nothing happened and they r going to expire. They did not reply to that email but good that they have not asked it yet. Do u think I need to do medicals for my 3 months baby too ?

Hello Canada_pr1,

They can extend the medicals if that was done within 15 months, but depends entirely upon officer's discretion. Perhaps, the officer already asked the extension for your medicals. That may be the reason that they are not asking it again. For sure, you case is moving since they are requesting additional documents. But I am not sure for the baby. Do they even require medicals for 3 months old? for what? Anyways they may advise you further. Better to wait for their response.

Yes you can call CIC and they will be able to tell you whether medicals have been extended or not. In my case, they told.

I just received my passports back with Visa stamped along with COPR.

I sent my passport to New York using Fedex along self addressed pre-paid Fedex envelope on 20th Feb 2013 and Passports reached New York Consulate on 21st Feb 2013.

Passport was sent back in USPS regular mail (I don't know why they didn't use my self addressed pre-paid Fedex envelope) on 15th March 2013 (got an email from New York consulate that passport along with COPR was sent out).

Today morning, I received them...

All the best to everyone on this forum and hope all Pre-June 2010 applicants will get they PPR soon...
