my application was rejected on 13th aug 2010. which i got back on 8th dec 2010. cap in 1122 got closed in nov 2010.afterwards i filed the judicial review case against cic decision in federal court, as they said i have not sent them my wifes civil documents papers, however they were intact in return file.
leave have been granted by the judge in mid june. final verdict will come on 25th sept.

please give advice, what should i do. should i file my application again as cap are only 500. my age is 46 years .although my lawyer says they will review the case frezing the date as 13th aug 2010 after judge ment.
please advice. qorax you also advice

Even if you win the case in September, the judge will not be granting you a visa, he will only be insisting that CIC re-open the case.

So in my opinion if you have the ability to re-gather the documents in time you may as well file another application post-July-2011, if that doesn't make it within the cap in time you still have your original application to fall back on if they ruling goes in your favour.

You may wish to wait until the full rules are published for 1st July onwards, since there is a strong likelyhood that the points matrix will change and that younger applicants (under 35) will be favoured, so as a 46 year old applicant you may not have as many points as you would have had under the original rules.

However, if your appeal is successful your original application will be assessed based on the rules at the time you applied.

NEW RULES FOR NEXT YEAR

Same 29 occupations as before, except they are limiting to 500 per NOC (with maximum 10,000) - so half the number of FSW1 as 2010-2011!

The good news is that with even less intake for 2011-2012, they will have more capacity with which to tackle pre-June-2010 applications.

not sure till now. they should release a grid paper like they released last year.

For others,

the change in Ecas means something is being done on the file. something, could be anything. we gotta wait to see.
 
As we all are taking it as a good news but I think, CIC really hasn't done very much. by lowering the cap to 10,000 is not as impressive as it seems,according to its website, since last June 26th, fewer than 14,000 new applications were received. In other words, the real increase for languishing applicants is less than 4,000 -- hardly enough to make a dent in the backlog and more importantly, the processing priority remains the same. Thus, those who apply from July 1st onward will be assessed first; then those who applied since last June 26th; then those who applied after 27 February 2007 and finally, those who applied before 27 February 2008. I doubt that the 4,000 spaces will get beyond those who applied since last June 26th.
