My husband is a born canadian citizen. Hes lived there all his life other than the few years he lived in the states with me. Im a born us citizen and have lived here all my life. We were married in the us in 2005...we have two children. He lived here until 2009 he had a work perit and then a green card. Then he moved back to canada. Me and his kids live in the us. We were wondering the best advice to go about getting us up there with him. My oldest is already in school and i believe all i will need is their records...papers..and a lease stating we live with their father and he is a ciizen of canada. How would i go about us being there...we were planning on moving around june 2013....is this unreasonable? What needs to be filed..what steps do i need to take?

Your children are already Canadian citizens since their Father is a Canadian born in Canada. Your next step is to get your children proof of Canadian citizenship (see http://www.cic.gc.ca/english/citizenship/proof.asp) and then a Canadian passport.

For you to move up, you have a few options. Your husband could sponsor you for PR status. The application is available at http://www.cic.gc.ca/english/information/applications/fc.asp. The timing is a bit uncertain right now because CIC closed down the Buffalo office and is just ramping up the Case Processing Pilot in Ottawa, ON to process US-based applications (they just started issuing visas on Nov 27). You may be able to get your PR approved by June. If not, you can visit your husband up in Canada (but not work or study) as a tourist while the application process completed. Alternatively, you can consider getting a work permit or applying for PR status based on your experience as a skilled worker or a job offer - what is your work experience?
 
Well, it's not that simple!

Your kids are probably already canadian because their father is. So for them, you need to apply for their passport, and they should be good to go.

For you, you need to be sponsored by your husband to become a permanent resident of Canada, and be legally allowed to stay in Canada as long as you want. it takes a while to fill out all the forms, and get everything ready, as well as wait for the paperwork to be completed.

You can apply either inland or outland. For US citizen, it's usually best to apply outland, because you can keep on travelling between the US and Canada, and you can start the application process now.

So - read the CIC website about sponsorship, print out the forms to understand what you need to do, and go ahead....

Outland currently is 43 days for stage 1 and 11 months for stage 2 - but a lot of people are done faster than that. Also - because you are from a visa-exempt country, you can go and stay in Canada even if your PR is not issued yet.

So technically - June 2013 is probably too early to have your paperwork completed ( depends how fast you fill out everyhting etc, but seems too short), but you could start now, and at the same time start the paperwork to get the citizenship certificate for your kids, and get them their canadian passport. In june 2013, you can move there, but you will have to go as a tourist if your PR is not issued yet - which means that you're not allowed to work, and depending on the province, no healthcare, until you have your PR. but you could still go.

You guys are a lot o help thank you very much. I knew it wouldnt be too easy nor would my supposed deadline be reasonable...having went through all the forms and proper actions to get my husbands green card. Looks like ill be printing and filing some forms this weekend lol

good luck! it's a bit confusing at first, but in your case it should be pretty straight forward, with a marriage and 2 kids, and your husband already back in Canada ( no need to prove that you will re-establish in Canada as he is already there) it should go fast.
