Bad News again........Decision Made after Interview

Ok then my theory is wrong then, then my opinion is with you you should appeal cause it doesn't makes any sense. Only with a Master they give you many points so i don't think the problem is there also.
 
Do you mind sharing how many years of experience you have?

I hv got refusal....if any one can help me to know how to appeal, I will appreciate that
 
Very Very sorry to hear about your situation Prabjot, before writing to anyone or making an appeal, my advice is to analyse the root cause of your refusal, i mean why VO is not satisfied with your experience? why he said to you during your interview that even your manager is not performing these duties?

there must be a reason, this is wt i guess.

I will talk to my consultants tomorrow. Let c what they will suggest. Its not just about Canada. Its about my emotions. My employer is sending me US in April. They wanted me to now itself. but I will eligible for L1 in April so I have to wait. H1 cap has been reached to end for this fiscal year..otherwise I would have applied till now.

I know my case was genuin and I gave all the proofs. If one VO is personally not satisfied CIC can not avoid my proofs.

I dont know what my consultants will say or what will be the result now. But I am going to fight for it now. If they were not satisfied with exp or job duties, they should have reject it at the time of initial review itself.

Please keep on sharing your exp. You all are my streanth now. I have already got refusal so there is no fear left now. If god wants me to fight for it, Let me show how far I can go with it.

prabjot your case is strong. even if you take visa office to court then the court can verify from your manager that you did perform those job duties.

visa officer has no proof that you did not perform those job duties. only your manager can verify that you performed all the job duties.

i think your case is very strong. take them to court.

My advice is to take it to the next step if you can afford, I think appeal process will cost you aroun 5000 cad$, but your case is strong visa officer just can not take a decision based on his beliefs and observation, totally ignoring the black and White proof, I mean written documents, only your company and Manager has a right to say yes or no regarding your job duties and their wording can not be ignored well they are the only one who can say yes she did or did not perform these duties, specially in countries like Pakistan and India we perform alot more job tasks then our actuall job designation other wise we can not keep on our seat. Go for appeal and don't miss your chance .

sorry to hear the rejection to your case madam prabjot.

Before you apply for appeal or reconsideration, as some one suggested work on the root cause,
In my opinion -
As you have mentioned that you have 5 yrs of exp and applied under IT Manager, you should consider that it will take you lot of efforts to prove that you were actually doing the PMs work, not just lil team management or working on RFPs or SoW.
Pl note that PMs in north america are with wealth of exp in technology and management. They will be evaluating you against current PMs lot in canada. You can do your self some research in canada job market and see the job ads for PMs ( you won't find very often PM required with total 5 yrs exp)
Also pl note, they don't need developers under NOC 0213 cat... They have become lot strict post 26june 2010 in their old case evaluation as well.

I can only wish as others did, good luck for your preparation in appeal procedures. But just don't overlooked the reality, we all know in India million of people works as PM ( only designation , they may not be doing whole project management -as mentioned in NOC 0213) with 5-8 yrs of exp. You may not be the one, but to satisfy VO there has to be different approach and presentation.

NOW I AM PLANNING AGAIN TO APPLY FOR IMMIGRATION TO CANADA WITH ANOTHER HOPE. SO DONT LOSE HOPE, BE POSITIVE BELIEVE ON YOURSELF.BELIEVE ON GOD.

Prabjot,

Sorry to hear about your case. If you are choosing not to go for appeal, write a letter to immigration minister-kennedy, CC to Canadian prime minister's office and Canadian high commission in India. Explain everything in letter and show additional proof to support your case.If your case is strong,they can reopen your file. It has happened with many in the past. My case was also rejected but they reopened it when they reralized that it was their fault.

I am not agree with Canadaviausa, I personally know so one who was working for the company as a systemanalyst for two plus years and before system analyst he works with me as a computer programmer he was computer programmer for 19 months and find an other job as a system analyst he work as a system analyst for two plus years then promoted in the same company as a Systems development manager, how can you justify it then his job includes the dealing with clients and projects on daily basis, he was promoted because he knows the company understand there pattern of work and has a good relations with clients, it all depends onhow well you perform i, and if you look at the requirements of INstitute of PRoject MAnagers, a you find out for the certification/designation of Pmp project manager professional there requirement is also 5 years experience and she has 5 exyears experience, she can be a project manager if she works hard and prove her skills.
